Daily Diary (DD) - Day 147 of 2026

0504hrs:

On this day of Eid we (3 of my co-citizens including my son and I) find ourselves waking up in Bagh rather than our respective homes in Sehnsa, Panjera & Khuiratta. A meeting with the incumbent 'prime minister' of AJK - that should have taken place when we were a matter of a few feet away in Muzaffarabad yesterday - has to be happen at least 140 kilometres away in the 'PM' s home village of Palangi (Mumtazabad) today. The distance from home in Sehnsa is another 140 or so kilometres away, where I should be with the rest of my family, as the PM is with his family.

This is just one more example of why there is almost zero governance in this territory. I have to meet him as I want to save lives in this utterly peaceful rights movement, that began just over 3 years ago and is swelling towards a genuinely free government (free from outside interference and equally responsible along with its citizens).

Here's the interview (courtesy Awam ki Awaz):

I'll re-produce the text note introducing this video, as follows:

Seeking the public stance of #PMAJK at his home village #DharraRajgan #Palangi #Mumtazabad #Haveli on Eid day (Wednesday 27 May 2026).

1) Maintaining #Peace in the territory at all cost.

Bringing all internal elements (legal title holders as opposed to claimants) onboard to ensure no further deaths occur in #AJK in the context of #RightsMovementAJK , by adopting a foolproof  internal #Security mechanism, without external interference.

2) Introducing financial #Transparency in all matters of public interest, particularly related to 'public representatives' in all shapes & forms.

Proceeding towards independent research, mukaalima (dialogue), inclusivity and financial transparency to make sense of where we all need to go, rather than relying on emotion, propaganda, exclusion and obfuscation to sustain the 'power' to exploit.

Daily Diary (DD) - Day 26 of 2026

0941hrs:

I didn't get up till 0900hrs, 6 hours later than intended. For some reason it was difficult sleeping last night and I didn't drop till past 0100hrs this morning. I did wake at 0300hrs but couldn't cope with the heavy shortfall of rest needed for a productive day.

I have a lot of work to do.

The following TikTok video presented by Sardar Ghaffar of Bagh provides an excellent summary of non governance in AJK, whereby the video is entitled as 'The Government of Azad Kashmir should change itself according to the changing conditions of the world' (English translation from Urdu):

He questions how a supposed government can repetitively spend about 90% of its annual budget on salaries & benefits while just building a few roads annually to show for that 'governance, year in year out. Yet the 2 most important deficiencies in AJK and directly related to the people's economy & well-being are electricity & internet connectivity, both of which need major investment in infrastructure, yet continue to be neglected.

Daily Diary (DD) - Day 236 of 2025

1342hrs:

Thankfully, getting prompter in logging my daily entry.

Still in Mirpur at in-laws.

....

We were clear that there were no snake bite vaccines in any health centre/hospital throughout AJK (even dog bite vaccines were rare if at all available). What we were not aware of was that these vaccines were present in Pakistani army camps. One such example emerged from Dawarandi Pakistani Army Camp today.

19 year old Bilal Nayazi s/o Abdus Sattar Nayazi of village Sehr Kohali was taken to the above mentioned army camp this morning after being bitten by a snake. However, the army there said they could not provide the vaccine without permission from their superiors, which it appears they were not ready to obtain. Hence, Bilal was then rushed to the tehsil headquarter hospital in Hajeera before being further referred to the district headquarter hospital in Rawalakot. Here, he has been given some other injections (not a vaccine against snake bites) and it is possible that he may survive the ordeal.

As one can gauge these are life or death scenarios and despite the elapse of 78 years, even basic services such as snake or even dog bite vaccines cannot be made available to the public here.

....

The following questions were put to me by an academic in the UK on the 24th of July (last month). Given my commitments I had to delay my response till this morning.

Questions:

I’m trying to apply the theory of internal colonialism to AK, with the help of the following questions:

Pakistan in Azad Kashmir

1. How did Pakistan first enter Azad Kashmir?
2. How has Pakistan impacted on the culture and social organization - indigenous values, orientations, and ways of life  - of Azad Kashmir?
3. How does Pakistan and its agents or representatives administer Azad Kashmir?
4. Are there any principles - of superiority and inferiority - utilised for social domination by Pakistan of Azad Kashmir?
5. Anything else?

Answers:

1) How did Pakistan first enter Azad Kashmir?

Initially, it entered in accordance with the Standstill Agreement (within the Indian Independence Act framework) post agreement on the 15th of August 1947 (having been offered to both India and Pakistan on the 12th of August, whereby the former deliberately stalled on deciding as subsequent events would reveal why). Although only a general announcement of this Standstill Agreement was published, indicating that some essential food items (salt), energy related oils (paraffin, petrol, diesel etc.) and postal services were to continue being sent/delivered to the State of Jammu & Kashmir (J & K for short here on), as they were during the British colonial era.

Within a few weeks Pakistan began dishonouring this agreement by stalling essential supplies, incidents of people being robbed enroute to or from Pakistan and J & K gradually became a regular occurrence. Pakistan also began quietly fomenting a rebellion (supplying arms and logistics) to the people of Poonch in particular. They also sent their own citizens to foment instability in the southern parts of what became AJK, in areas such as what constitute districts Mirpur and Bhimber today.

What were essentially a series of measures to destabilise what became the territory of AJK, gradually led to the execution of ‘Operation Gulmarg’ whereby thousands of tribal Pathan raiders (closely but subtly led and aided by Pakistan’s military which of course like the Indian army was led by the British) entered the State of J & K in the early hours of the morning on the 22nd of October 1947.

With this invasion, the Standstill Agreement had now categorically ended and Pakistan’s presence in what is today c. 35% of the State of J & K continues.

2) How has Pakistan impacted on the culture and social organization - indigenous values, orientations, and ways of life  - of Azad Kashmir?

In every sense. There is no aspect of life from Security, Governance, Economy & Culture that Pakistan has not adversely affected. My own estimate is that we are losing c. $20 billion (US) dollars a year on account of their presence here in AJK (I’m not including the territory of Gilgit Baltistan in this estimate). Perhaps most critical is that they claim a monopoly on all forms of public narrative in the territory (including the past, present & future).

Geographically, we have become isolated from all directions (including Gilgit Baltistan) except where we are adjacent to the territory of Pakistan. Our access to the outside world is also only via Pakistan. In such circumstances, there is almost zero choice for the people of this territory to not adopt all aspects of life and administration, as are prevalent in the adjacent areas of Pakistan.

3) How does Pakistan and its agents or representatives administer Azad Kashmir?

They infiltrate into each and every aspect of life here and try to manipulate or influence anything that is of potential economic benefit to them, or what they perceive to be harmful to the suffocating monopoly of their imposed public narrative, which is essentially designed to keep people ignorant or complicit in their corruption.

If they can’t affect you in public spaces (by manipulating your access to economic opportunities or by marginalising you through use of targeted propaganda to defame you) they will try and influence somebody close to you in your family and create disruption, misunderstanding or fear in close members of your family, to ensure their ‘interests’ are not harmed.

4) Are there any principles - of superiority and inferiority - utilised for social domination by Pakistan of Azad Kashmir?

Pakistan’s main theme is Muslim/Non-Muslim (especially Hindus, then Jews and then Christians) presenting themselves as protectors of Muslims globally and especially in the region vis a vis India. It is a hate driven formula which ensures that no Non Muslim can possibly sustainably live in AJK.

They do pander to the historically dominant ruling tribes/clans of the region and try to ensure their complicity in whatever they do here. However, their major distinction of superior/inferior is based on who follows their narrative and who doesn’t. Whoever follows can expect to gain favour and whoever doesn’t will inevitably face their wrath.

5) Anything else?

To understand how Pakistan behaves in AJK or for that matter, how they operated in Bangladesh (although in this specific case they tried to use race and language to impose their advantage or supposed superiority), in Gilgit Baltistan or how they deal with Balochistan, Sindh, KPK or even areas in Southern Punjab; it is important to understand that Pakistan is essentially a country designed by Britain to be a conflict economy facilitator (Korean War 1950s, Afghanistan 1980s and 2000s) and not to develop indigenously as a self sufficient economy, utilising its abundant natural resources for its people which - if human capital were its priority – would have made Pakistan one of the most lucrative markets in the world.

The elite in Pakistan is primarily made up of those families which not only facilitated British colonialism but also facilitated all previous powers too. Thus, comprising of the core of Western Punjab (essentially) it lies on the route between Kabul and Delhi, whereby most pre British powers who ruled the region, used this route to conquer Delhi, the seat of power for the past 1,000 years or so. These people have developed a genetic knack of assessing (usually correctly) whether the prevalent ruler in Delhi is stronger than the next power entering from the Khyber Pass.

In summary, complicity with larger powers is what has been in practice for at least a 1,000 years (Ranjeet Singh of the Punjab was an aberration in this regard), in the region where the Pakistani elite has its power base. This is also the modus operandi since 1947 viz. operate under the umbrella of larger powers (scratching their back so to speak) and dominate peripheral areas to extract resources to the maximum and base your public narrative in and around these realities. What may be a distinguishing factor in this era is the way religion and religious identity has been exploited. It is perhaps unprecedented in Islamic history, even from its inception c. 1,400 years ago.

The past 24 hours were markedly more productive than the preceding set of 24 hours over the past week or so, since I made a solid intention to change my sleeping pattern from 2000hrs (8pm) to 0300hrs (3am) from hereon.

Last night, I did 'hit the sack' at 2000hrs but was woken intermittently by a high fever in my youngest child Shams-Udeen until around midnight. Thankfully his temperature came down gradually and I was able to sleep until 0430hrs. One and a half hours later than intended but much better than the previous days referenced above.

1155hrs:

Now that I have received confirmation today (by phone from the Assistant Commissioner's office, Sehnsa) that my dear paternal uncle (Taya Munshi) has indeed made an application to the Assistant Commissioner (AC), in reference to wanting the endemically corrupt administration of AJK, to assist him in securing his preferred share of the family inherited land of 27 Kanaals (c. 3.4 acres) divided by 3 (brothers), meaning each brother is entitled to a 9 kanaal (c. 1.1 acre) share.

We don't have a problem with his share, we just have a problem with him (Taya Munshi) insisting and conniving with the administration to try and take land which comes in our share, just because some of it happens to coincide with the main road.

He already has land on the main road and has built a number of shops in his share of the land but wants more, at out cost as we are not intent on taking commercial benefit of land that is adjacent to our residence. We just don't need the commotion that commercialism brings to the neighbourhood. We'd rather make effort on restoring nature in our vicinity.

We have to now engage in countering his greed.

Further analysis of the status of AJK as a territory is provided by Dr Nazir Gilani today:

A Dereliction of the Kashmir Cause

The Government of Azad Jammu and Kashmir (AJK) has grievously misdirected itself by neglecting its constitutional role in the Kashmir dispute, especially as outlined in the United Nations Commission for India and Pakistan (UNCIP) Resolutions. These resolutions bind AJK to work alongside Pakistan in securing the right to self-determination for the Kashmiri people, primarily through a plebiscite. However, the Azad Kashmir governments have consistently failed to discharge this responsibility, which has undermined the legal and moral case for Kashmir’s self-determination.

1. Breach of Constitutional Mandate: Azad Kashmir’s role is not merely as a local authority but as a constitutional partner in the framework established by the UNCIP Resolutions. These resolutions call for joint action with Pakistan to facilitate a plebiscite for Kashmir. The AJK leadership’s claim of being constrained by its status as a local authority is an excuse designed to avoid fulfilling this duty. The government's failure to act has debilitated Kashmir's international standing and weakened the movement for self-determination.

2. Political Compromise at the Cost of Kashmir’s Cause: The leadership in AJK has consistently prioritized maintaining political power and personal privileges over the interests of the Kashmiri people. This was evident in their inadequate response to India's illegal actions of August 5, 2019. Rather than rallying for a strategic and unified response, the AJK government has been preoccupied with political optics that have failed to bring meaningful change or progress to the Kashmir cause. Their pursuit of power has come at the expense of the core issue: the right of the Kashmiri people to decide their future.

3. Corruption and Questionable Wealth: A striking feature of the political leadership in Azad Kashmir is the stark disparity between their humble beginnings and the unexplained wealth they accumulate while in power. This raises serious questions about their motives. The continued personal enrichment of those in power, coupled with their neglect of the Kashmir cause, has led to public disillusionment and undermined their credibility. The leadership’s indulgence in luxury and political compromises directly harms the integrity of the Kashmir struggle.

4. Failure to Respond to India's Aggression: A key moment of failure was the Azad Kashmir government’s inaction following India's revocation of Article 370 on August 5, 2019, which further entrenched the illegal occupation of Jammu and Kashmir. Instead of mobilizing support and presenting a united, forceful response, the AJK leadership chose a path of inaction, opting for ineffective gestures over substantive resistance. This passivity has further marginalized the Kashmiri voice in international forums and allowed India to proceed unchecked in its efforts to alter the region's status.

5. Pakistan’s Responsibility: Pakistan has a higher burden in guiding and assisting Azad Kashmir in fulfilling its constitutional obligations. As the primary international advocate for Kashmir, Pakistan must ensure that Azad Kashmir’s leadership is not only politically engaged but also ethically and legally committed to advancing Kashmir's right to self-determination. This requires a concerted effort to reset the strategic approach, ensuring that both Pakistan and Azad Kashmir act in tandem to fulfill their joint constitutional responsibilities under the UNCIP Resolutions.

6. Damage to the Kashmir Jurisprudence: By failing to act, the Azad Kashmir governments have significantly weakened the legal framework that underpins the Kashmir dispute. Their inaction has eroded the moral and legal arguments for Kashmir's right to self-determination, both domestically and internationally. The longer Azad Kashmir’s leadership remains passive, the more difficult it will be to present a united front that respects the pluralistic nature of Kashmir’s society, which includes Muslims, Hindus, Sikhs, Christians and others, as recognized by the United Nations.

Conclusion:
The Government of Azad Jammu and Kashmir has not only misdirected itself but also harmed the Kashmir cause through neglect, political compromise, and failure to act on its constitutional duties. Pakistan, as a key partner, must recalibrate its approach, ensuring that Azad Kashmir fulfills its constitutional role in the struggle for self-determination.

This is not merely a political challenge but a moral and legal imperative, one that requires decisive leadership, transparency, and an unwavering commitment to the rights of the Kashmiri people.

Daily Diary (DD) - Day 10 of 2025

1040hrs:

5 hours and 40 minutes later than intended.

....

Dr Nazir Gilani is making most optimum use of his time and expertise for the nation of 'Kashmiris' in particular. It is one of the tragedies of this beautiful land that its people do not recognise merit among themselves. They seek unjustifiable strength from outside while repeatedly overlooking strength on the inside, between their own. In the case of the AJK Government, who needs a roadmap when its patrons and appeasers are content with swinging around a roundabout endlessly?

Actionable Roadmap on Kashmir

Honourable Prime Minister,

It is a surprise and a disappointment that, after 77 years, 2 months, and 17 days since the establishment of Azad Jammu and Kashmir (AJK), and 77 years and 10 days since the Kashmir issue was first raised at the United Nations (UN), we are still unable to produce a clear, actionable roadmap for the Kashmiri people's freedom.

This delay is not just an administrative failure; it is a profound injustice to those who have suffered for generations. Kashmir has lost a whole generation, and the impact of this deficit will have far-reaching consequences, particularly in the context of any future UN-supervised vote on self-determination. The region is not only dismembered but has also been stripped of its legislature, its special rights, and its dignity. India, a UN member, has blatantly violated its Charter obligations and the UN template on Kashmir.
On January 5, you called upon the All Parties Hurriyat Conference (APHC) to deliver a  “clear” and “actionable” roadmap for Kashmir’s freedom. While your intent is commendable, this request raises a series of urgent and critical questions that must be addressed now, rather than later.

1. Why Start From Scratch?
The AJK Government was established in October 1947, and the APHC has adhered to a constitutional discipline since 1993—aligned with the UN’s framework on Kashmir. Given this history, why are we still asking the APHC to come up with something new? Why hasn’t the AJK Government already produced a clear roadmap based on these established principles and historical momentum? We have frameworks, principles, and international support already in place—why are we failing to act on them?

2. Leveraging Existing Legal Frameworks
The AJK Government operates under the 1970 and 1974 Acts, which provide a strong legal foundation to address the Kashmir issue. These acts, combined with the UN’s resolutions, lay out a clear path forward. Why is the AJK Government not using these frameworks to advance the Kashmir cause immediately? Instead of asking the APHC to reinvent the wheel, shouldn’t the existing legal and constitutional mechanisms be fully utilized to advance our case on the global stage?

3. The 9-Point Formula of 2019
In May 2019, the President of AJK presented a 9-point formula to the OIC Contact Group on Kashmir in Jeddah. If it was duly debated and approved, what happened to it? Why is the APHC being tasked with coming up with something new in 2025. APHC has a constitutional roadmap.

4. India’s Violations: What Has Changed?
India, as a UN member state, has blatantly violated its obligations by revoking Kashmir’s special status on August 5, 2019, in direct contradiction to the spirit and letter of UN resolutions. Given this violation, why is the AJK Government now calling for a new “roadmap”? Shouldn’t the international community, led by the “AJK Government”, be holding India accountable for its unlawful actions, rather than reimagining the Kashmir cause from scratch?

5. The AJK Government's Role:
It is profoundly concerning that, after all these years, the AJK Government is still waiting for the APHC to create a roadmap. The responsibility for action has long been with the AJK Government. Why, after 77 years, is the government still not prepared to lead the charge? A coherent, well-thought-out strategy should have been in place decades ago, yet here we are asking the APHC to step in and fill the void. What specific actions will the AJK Government take to lead the struggle, to bring Kashmir’s case to the international stage, and to hold India accountable for its actions?

Conclusion:
Prime Minister, while your call for a “clear” and “actionable” roadmap is necessary, the reality is that we are far beyond the point where such a request should have been made. The roadmap should already exist, based on the frameworks and agreements that have been in place for decades. The 9-point formula of 2019, the UN resolutions, and the AJK Government’s own constitutional frameworks already provide the groundwork for a comprehensive, actionable strategy.

It is time for leadership, not procrastination. Kashmir’s cause deserves a strategy that reflects its historical and legal rights. It deserves a plan that holds India accountable for its violations of international law and reasserts the Kashmiri people’s right to self-determination. We need a roadmap, but we already have the tools and frameworks to create it. The question is: when will we use them?

We continue with our daily vlog via Facebook Live:

Our people have always been in search of short cuts to resolve an increasingly complex and entangled problem viz. restoring the people's #Right2Rule in #AJK > #JKA
They will have to follow the right sequence viz.

1) Securing a public mandate from over 95% of the voting population.

2) Identify political representatives from each political constituency, while ensuring each constituency has an equally proportionate population.

3) Fulfilling all technical (legal, constitutional, social, economic, security etc.) requirements.

4) Operate a genuinely free government in AJK that can increase the economic livelihood opportunities of the people 100x over.

Making or joining a political party are not sufficient to fulfill the above process, though their role in the second part of the sequence is crucial.

Daily Diary (DD) - Day 360 of 2024

2302hrs:

Trying once again to make ground on time.

....

We continue to try and make full use of Dr Nazir Gilani's presence in the vicinity by cross referencing his note on the Joint Awami Action Committee (JAAC) today:

احتیاط
عوامی ایکشن کمیٹی بمقابلہ حکومت آزاد کشمیر

The Joint Action Committee (JAC) VS the Government of Azad Kashmir

Be careful in responding to a genuine grassroots struggle for socio-economic rights
The Joint Action Committee (JAC) movement in Azad Jammu and Kashmir (AJK), which seeks affordable electricity tariffs, subsidized flour, and other essential provisions, represents a genuine grassroots struggle for socio-economic rights. The criticism levelled against it for neglecting broader political issues, such as India's actions on 5 August 2019, and the baseless allegation of being "India-sponsored," reflects a historical pattern of discrediting dissent in AJK. However, both historical and international precedents substantiate the legitimacy of the JAC’s demands and counter these criticisms.

Historical Context and Pakistan’s Precedents

Pakistan’s approach during critical historical moments provides a strong foundation to defend the JAC's focus on socio-economic concerns. In response to India's complaint to the UN Security Council (UNSC) on 1 January 1948, Pakistan submitted three documents on 15 January 1948 outlining six demands. These demands addressed a spectrum of issues beyond Kashmir, including:

1. Allegations of Genocide: Pakistan raised concerns about atrocities against Muslims in East Punjab and Delhi.

2. Occupation of Junagadh: Pakistan opposed India's annexation of Junagadh, advocating for the self-determination of its people.

3. Military Threats: Pakistan highlighted India's alleged threats of military aggression.

4. Interference in Hyderabad: Concerns about India’s stance toward the princely state of Hyderabad were also emphasized.

5. Economic Coercion: Pakistan addressed the economic pressures stemming from the partition, including disputes over resources.

6. Kashmir Dispute: While significant, Kashmir was one of many issues presented to the UNSC.

This multifaceted approach demonstrated Pakistan’s recognition of diverse challenges and the need to address them collectively, rather than focusing singularly on one issue. Criticizing the JAC for prioritizing socio-economic grievances over Kashmir mirrors the narrow thinking that Pakistan itself rejected in 1948.

Defence of the JAC Movement

1. Legitimacy of Popular Movements: The JAC’s demands align with fundamental human rights, such as access to affordable resources and economic stability, enshrined in international law through instruments like the Universal Declaration of Human Rights (UDHR). Labelling such a movement as “India-sponsored” disregards the genuine hardships faced by the people and echoes a discrediting tactic historically used in AJK since 1948.

2. UN Perspective on Constituencies: Accusations of being “India-sponsored” inadvertently validate the existence of an Indian constituency in AJK, akin to the recognized Pakistani constituency in Indian-administered Jammu and Kashmir. Under UN frameworks, this symmetry necessitates equal legitimacy and protection for all constituencies advocating for their rights in contested territories.

3. Relevance of Socio-Economic Rights: Addressing immediate socio-economic issues does not diminish the importance of larger political contexts like the Kashmir dispute. On the contrary, alleviating basic hardships strengthens the foundation for political engagement and ensures that the population is empowered to advocate for their broader rights effectively.

4. Historical Symmetry: Pakistan has historically championed the cause of Kashmiri self-determination in Indian-administered territories, framing such movements as legitimate expressions of popular will. Applying a double standard to similar expressions of dissent in AJK undermines Pakistan’s principled stance on human rights and self-determination.

Conclusion

The JAC movement’s focus on socio-economic rights is consistent with Pakistan’s own historical strategy of addressing multiple issues simultaneously. Discrediting the movement with baseless allegations of foreign sponsorship ignores its genuine grievances and the precedent set by Pakistan at the UN in 1948. Recognizing and addressing these demands aligns with international principles, enhances the legitimacy of governance in AJK, and strengthens the moral and political foundation for addressing the broader Kashmir dispute.

This following note by our foremost expert on the UN template on Jammu Kashmir namely Dr Nazir Gilani will be an important reference in the coming weeks, months and ultimately years:

ناکامی کے ذمہ دار

آئینی ذمہ داریوں سے انحراف!

Argument: The Failure of Azad Kashmir and Pakistan to Discharge Constitutional Duties and Its Impact on the Kashmiri Cause

__________________a______________________

1. The Constitutional Responsibility to Institutionalize Plebiscite Efforts

1. The Mandate of Section 8 of the AJK Act 1970 and Section 11 of the AJK Act 1974

o These constitutional provisions explicitly obligate the Azad Jammu and Kashmir (AJK) Government to institute a framework for plebiscite advocacy, which is central to the Kashmir issue.

o Section 11 of the 1974 Act reinforces AJK’s role as a base camp for the Kashmiri struggle, specifically requiring the government to work toward facilitating a plebiscite under UN supervision.

2. The High Court’s 1999 Judgment

o The AJK High Court's ruling in April 1999 directed the government to appoint a Plebiscite Advisor (PA) and institutionalize efforts for a plebiscite. The judgment also set qualifications for the PA to ensure effective advocacy at national and international levels.

o This judgment was an opportunity for AJK to strengthen the Kashmiri narrative, fulfill its constitutional duties, and operationalize its role in the Kashmir dispute.

3. AJK Government’s Defiance and Lame Excuses

o The government’s failure to act on the judgment, citing budgetary constraints and Indian unpreparedness, reflects negligence and contempt of court.

o These excuses are laughable because:

 Budgetary Constraints: The allocation of resources for the plebiscite framework is central to AJK’s constitutional role, and prioritizing it over other expenditures was necessary.

 Indian Unpreparedness: The mandate of the plebiscite framework under Section 11 is independent of India’s actions. AJK assumed responsibilities under UNCIP (United Nations Commission for India and Pakistan), and its duties are not contingent on Indian readiness.

2. Impact of Neglecting the Plebiscite Framework on 5 August 2019

1. Institutional Framework Would Have Strengthened Kashmir’s Position

o If the AJK Government had acted promptly in 1999, the appointment of a Plebiscite Advisor and institutionalization of plebiscite advocacy would have:

 Built International Support: The PA would have spearheaded global awareness campaigns, engaged with international bodies, and pressured India diplomatically.

 Mobilized National and Diaspora Advocacy: The PA would have united the Kashmiri diaspora and galvanized public opinion, creating sustained pressure on both India and Pakistan to adhere to UN resolutions.

 Blocked India’s Narrative: India’s unilateral action on 5 August 2019 to revoke J&K’s special status under Article 370 could have faced significant global resistance if a robust Kashmiri-led advocacy framework was in place.

2. Strengthened Kashmiri Agency

o The framework would have empowered the Kashmiri people to lead the discourse on their future. This could have prevented the reliance on Pakistan’s often self-interested representation of the Kashmiri cause.

3. Eroded India’s Justification for 5 August 2019

o India has consistently argued that the lack of organized Kashmiri advocacy justifies its unilateral actions. A robust institutional framework in AJK would have countered this narrative, making it harder for India to claim J&K’s integration into the Union.

3. Failure of AJK and Pakistan: Exploiting a Compliant Kashmiri Leadership

1. A Culture of Compliant Leadership

o By neglecting its constitutional duties and defying the High Court judgment, the AJK Government has created an environment where compliant leadership thrives.

o Both the AJK Government and Pakistan have exploited this compliant leadership to maintain control over the Kashmiri narrative, sidelining genuine Kashmiri voices advocating for self-determination.

2. Pakistan’s Role as a Party with Interests

o Pakistan’s approach often prioritizes its territorial claims over the aspirations of the Kashmiri people. By failing to support the institutionalization of plebiscite efforts, Pakistan has weakened its credibility as an advocate for Kashmiris.

4. The Merits of JKCHR’s Work on Section 11 of the AJK Act 1974

1. Visionary Leadership and Advocacy

o JKCHR’s petition in 1992 was a pioneering effort to compel the AJK Government to fulfill its constitutional obligations. By focusing on Section 11, JKCHR emphasized the importance of institutionalizing advocacy for the plebiscite as a cornerstone of the Kashmiri struggle.

2. Addressing Neglect and Accountability

o The petition highlighted the longstanding neglect of constitutional duties by the AJK Government and called for accountability. JKCHR’s work exposed the lack of political will and administrative initiative, forcing the issue into the judicial domain.

3. A Roadmap for the Future

o The High Court’s 1999 judgment, catalyzed by JKCHR’s efforts, provided a clear roadmap for plebiscite advocacy, including the appointment of a qualified Plebiscite Advisor.

o JKCHR’s emphasis on implementing this framework remains relevant today, as it is essential for reclaiming Kashmiri agency and countering India’s unilateralism.

5. Educating the Public: Raising Awareness of Neglect

1. Expose the AJK Government’s Failures

o Public campaigns should focus on educating Kashmiris about how the AJK Government’s neglect of the High Court judgment weakened their position internationally and allowed India to act unilaterally on 5 August 2019.

2. Highlight JKCHR’s Role

o Efforts like those of JKCHR must be celebrated and amplified as examples of visionary leadership. This will inspire others to hold the AJK Government and Pakistan accountable for their inaction.

3. Mobilize Civil Society and Grassroots Movements

o Civil society organizations and grassroots movements must be empowered to demand the implementation of the High Court’s judgment and advocate for Kashmiri-led initiatives.

6. Conclusion: A Missed Opportunity and the Path Forward

The failure of the AJK Government and Pakistan to act on the 1999 High Court judgment institutionalizing plebiscite advocacy is a grave dereliction of duty. This neglect not only undermined the Kashmiri cause but also enabled India’s unilateral actions on 5 August 2019.

JKCHR’s work on Section 11 of the AJK Act 1974 remains a blueprint for reclaiming Kashmiri agency. Moving forward, the Kashmiri people must demand accountability from both the AJK Government and Pakistan, reject compliant leadership, and establish a robust institutional framework that centers their aspirations and voices on the global stage. Only by reclaiming ownership of their cause can Kashmiris effectively counter the narratives imposed by both India and Pakistan.

Daily Diary (DD) - Day 290 of 2023

2323hrs:

It has rained quite heavily for 2 days in a row now. This has changed our climate from summer to winter in a flash it seems.

Despite these challenges for people's manoeuvrability and the associated burden on our weak infrastructure, our students from throughout AJK came out in strong numbers to support #RightsMovementAJK , into its sixth month of daily protest for basic needs which the government is unable to deliver.

2312hrs:

Wherever and whenever progress is made in the territory of Jammu Kashmir & Allied areas #JKA various thorns and diversions surface to break the flow.

However, over the years we have become adept at navigating these genetic hurdles, which have been inculcated in our people from centuries of practice.

Our targeting of hypocrites who pretend to be freedom fighters while tacitly and sometimes openly supporting corrupt governance in AJK continues.

Hypocrite Number 1 = Wahid Kashar

We have documented his approach and strategy and will not let him rest till he retires from the public domain:

Daily Diary (DD) - Day 149 of 2023

1243hrs:

Rolling on on Day 7 of #AJKReferendum2023

All activists working on governance in AJK are having to pay for 76 years of negligence. We have to put in extra efforts to do all those tasks that over 110,000 governments servants in AJK have failed to do in all these years.

They've all been rewarded with wages, paid expenses and many have also benefitted from the many avenues of corruption. Meanwhile, activists have had to rely on their own sources or menial handouts from well wishers in the community. Government servants have accumulated assets over all these years, secured their children's future and enjoy pensions in retirement. Activists have to deal with extra oppression for struggling for people's rights, face immediate risks of poverty and also have to face criticism from their own families for putting the public's needs ahead of their own families.

Indeed, political activism in AJK has been guilty of bifurcating the freedom struggle from governance, hence this dichotomy mentioned above.

We are now deeply engaged in addressing this error of judgement.

#AJKReferendum2023 should prove to be the basis of modern day 21st century governance in AJK. Whereby the freedom struggle integrates itself with the day to day needs of governance.

....

So, it took less than 3 days for the Pakistani army to back down from its abduction policy in AJK.

Israr Ahmed was released late in the afternoon today after activists had threatened to block the main highway between Mirpur & Kotli at Plaak, near Dadyaal. It is vivid that AJK is not Pakistan. It is also clear that if the people of AJK put their heads together, driving the Pakistani army out of this territory is not as difficult as many of us envisage:
