Daily Diary (DD) - Day 126 of 2023

Getting sharper....

There are some notable points in your written analysis of JKA and there are very few who have worked in the AJK governing structure who can speak and write with such fluidity, as your good self.

Nevertheless, there are some parts of your argument that could be described as 'subjective assumptions' and which leave a lot of room for alternative interpretation. 

Examples:

1) That this is a Kashmir Valley centric problem when it is far more complex than that. The fundamental rights of people throughout AJK, Gilgit Baltistan, Jammu, Kashmir & Ladakh have been severely limited or compromised since the entry of Indian and Pakistani troops within the territory in October 1947.

2) Without being partial to any particular era it is clear that the level of parity in official documents between the Dogra State and the British Indian colonial set-up was objectively more visible under autocratic constitutionalism than the so-called democratic constitutionalism undertaken by India and Pakistan in JKA. Compare the 1904 Upper Jhelum Water Agreement and the 1935 Gilgit Lease Agreement with any post 1947 document e.g. Karachi Agreement 1949 or Delhi Agreement 1952....the lack of parity between parties became even more acute subsequently.

3) It would be presumptuous to argue that Gilgit had no historic link to the Valley, Jammu or what is today AJK when there are divided families and divided cultures criss-crossing each part of the geographic divide. It would be absurd to expect them to be totally in sync with each other, when they have been deliberately divided since 1947. One can also compare modern day India and Pakistan which are not internally divided like we are...yet how strong are the bonds between Quetta and Karachi or the latter with Peshawar or Lahore? What is the affinity between someone living in Simla with someone living in Chennai or between Trivandrum and Patna? 

4) Until India and Pakistan do not treat the people of JKA as equals in humanity, concerns and aspirations we will continue facing an uphill task and while India will continue to economically rise, Pakistan's economy will dwindle further below 0.4% share of global GDP.

Modern politics must be that of inclusivity of all political narratives in JKA rather than cruelly expecting the people here to adopt a singular Indian or Pakistani nationalist narrative.

Neither can the people's reference in JKA be wished away by India and Pakistan, under the cloak of IndoPak Bilateralism.

That is insulting, putrid and reminiscent of human slavery.

It is after many a year that we have managed to obtain an - on the record - microscopic view of the Pakistani State narrative on Jammu Kashmir & Allied areas (JKA). 

With all due respect to the 86 year old PMLN chairman Raja Zafar ul Haq, perhaps the most seasoned - Pakistani politician alive - Pakistan only wants a solution that suits it or no solution at all, come what may. 

It is also sadly obvious that Pakistan will continue to lie and deceive the inhabitants of JKA, in order to take as much of the territory it can, even if that means sharing it with China, India, UK, USA or even any other claimant that shows serious intent, as long as it doesn't have to concede an inch to the titled inhabitants.

After a few days of progress I have slipped once again.

A backfooted 'rationalising' attitude displayed by - Pakistan's Advisor to the Prime Minister on Kashmir Affairs and Gilgit Baltistan - or just another example of Pakistani legerdemain in Muzaffarabad?


We are certain that Qamar Zaman Kaira is working hard to downplay Pakistan's annexation attempt.

He describes the problem as an administrative one in terms of there being no clear link between AJK and the federation of Pakistan, in terms of administering the appropriate share of Pakistan's federal finance to AJK, as it isn't a province or a constitutional part of Pakistan. Further that the Pakistani prime minister as chairman of the (now advisory post 13th amendment) Kashmir Council is not a sufficient enough bridge. 

Kaira is categorically saying that there is no intention to take back financial powers from the AJK government via the Kashmir Council (obtained via 13th amendment).

He is also categorically saying that there is no attempt to provincialise (or federalise) AJK.

Qamar Zaman Kaira describes the proposed (15th) amendment as a list of suggestions which required feedback from the AJK government, that it is open to revision and is of course subject to acceptance by the AJK Assembly.  

He ends (this particular video clip) with an attempt to butter the audience by using the terminology 'special status' for AJK.

What we are saying is:

You need to de-link from us all together as siding with you (or any other country) is an automatic liability for the most sought after territory in the world. We can only prosper if we are independent. We cannot be independent unless we are neutral towards every other country on earth. The world will only believe us if we can provide a powerful enough ethical argument as to why this is a more meaningful alternative to regional occupation (China, India and Pakistan) and superpower contests between (China and USA).  

Possessing world class water management technology and delivering religious harmony are 2 clues to this ethical argument.

As a footnote, we also understand that all other political parties in the AJK Legislative Assembly boycotted Qamar Zaman Kaira's visit to Muzaffarabad, except his own party, namely PPP (Pakistan People's Party).

Rawalakot: 

(A huge rally in aid of) Jammu Kashmir National Awami Party (JKNAP) president Liaqat Hayat and other political prisoners (was taken out by the public of Rawalakot) protesting against the arrest and police violence (against their co-citizens). (Further, the public is seething) against (regularly) imposed electricity (power) cuts, cruel taxes on electricity bills, the proposed 15th constitutional amendment (to annex AJK), the (proposed) tourism act and against the excessive (luxury) facilities (provided via our taxes) to our bureaucrats and politicians. 

This activity was co-ordinated by the All Azad Kashmir Trader's Association which conducted a shut-down of all businesses throughout the Poonch division (which has 4 districts). All trade was suspended and all shops remained closed. A historic rally was taken out (through the city of Rawalakot) under the supervision of the Rawalakot Trader's Association and led by Abdul Naeem Khan.

Your response should not be optional or voluntary, it is compulsory - in my bruised opinion - given the nature of our current situation in AJK.

Public Policy Themes:

1) Security
We want to keep the peace. It requires discussing demilitarisation on a practical level with local civil society in AJK and framing a documented outcome that will confirm clarity of thinking for the 'international community'.

2) Governance 
Continue with our census data collection activity and parliamentary practice of direct democracy via the #PublicAssemblyAJK

3) Economy
Continue with collection of a voluntary public tax to safeguard public interest (exclusive to the titled inhabitants of JKA) against anything unlawful, unconstitutional, unjust and unreported: such as intra communication documentation between India, Pakistan, China, USA, UK on JKA.

4) Culture
Continue with reviving the Mandir of Sharda and Gurdwara of Ali Beg in Bhimber. Aligned to which we are pursuing the greater civilisational pursuit of reviving Sharda as a preeminent University of the world.   

I'm sure that you understand that the people of AJK are doing the maximum - in a civil manner - to stop the Pakistanis from annexing our territory. However, the Pakistanis will not avert this - not least because they are heavily indebted to the world - yet we still have to prevent this. Public opinion is visible, the public is active throughout the territory on a daily basis with total shutdowns becoming more frequent, as in #Poonch division today.

What is missing to prevent this is a central parliamentary platform that addresses the democratic deficit in our society. We have the legal references, we have an ethical argument, we are peacefully pursuing our objectives but.................a Public Assembly must be convened with political representation from throughout the territory. Due to modern technology, everybody doesn't have to be physically in the same place. It must happen before Pakistan takes this step.

Your thoughts on paper are vital at this stage.....

The international community requires clarity of political representation and public opinion in order to be activated on Jammu Kashmir & Allied areas (JKA).

This applies to any international conflict resolution platform....be it the UK, UN, USA or other.

External narrative:

1- سیکیورٹی

ہم امن قائم رکھنا چاہتے ہیں۔ اس کے لئے آذاد جموں کشمیر کی مقامی سول سوسائٹی سے  فوجی انخلا کا تذکرہ عملی بنیاد پر ڈسکس ہونا چاہئے جس کے نتیجہ میں ایک دستاویزی نتیجہ ملنا چاہئے جس سے یہ بین الاقوامی دنیا کو یہ سمجھنے میں آسانی ہو کہ یہاں کے لوگ کیا سوچتے ہیں

اس سازش کو روکنے کے لئے ہمیں ایک مرکزی جمہوری محاذ چاہئے جو یہاں کی جمہوری قلت کو دور کرے،ہمارے پاس قانونی ریفرنسز، اخلاقی مدعے بھی ہمارے حق میں ہیں اور ہم پرامن طریقے سے اپنے اہداف کی طرف بڑھ رہے ہیں لیکن ایک عوامی اسمبلی کا اجلاس بلانا، جس میں پوری ریاست جموں کشمیر و متحدہ علاقہ جات کی سیاسی نمائندگی ہو، ضروری ہے اور آج جدید ٹیکنالوجی کی وجہ ہر کسی کو ایک جگہ پہ ہونا ضروری نہیں ہے۔اس سے پہلے کہ پاکستان ایسا کوئی اقدام اٹھائے اس عوامی اسمبلی کا اجلاس ہونا چاہیے۔

Daily Diary (DD) - Day 213 of 2022

I did venture out to the Square in the afternoon once again - after a break of 2 days - to express solidarity with all our political prisoners; including those of JKNAP, JKNSF and others. However, I forgot to take a customary picture on entry.

It is the first day of August, a memorable month over the years for us in Jammu Kashmir & Allied areas (JKA). The number 47 and the words forced, fortification and other less pleasant words come to mind in Dadyaal AJK, at the minute.

Then I decide to transport the above to another social medium, as a tweet:

It is obvious that the Pakistanis have thrown caution to the wind:

The following is an example of how the Pakistanis try to hoodwink the world on Jammu Kashmir:

A Scottish activist - Claire Bidwell - who has been vigorously, sincerely and wholeheartedly campaigning for a just and democratic solution to the 'Kashmir Issue' - effectively soon after India swooped to annex its controlled part of JKA into its federation on August the 5th 2019 - has been spun a yarn by the Pakistanis that if the inhabitants of JKA vote to accede to them, then they will give them the right to be independent, which they argue is otherwise unavailable!

How they've treated us (in terms of trying to control our thoughts to extracting our resources) over the past 75 years is more indicative of their behaviour and intent. Their words have a repetitive pattern to it, viz. promise the world to a people by exploiting their religious sentiments and then exploit their land & resources to your heart's desire. 

This was precisely her question to me:

"Am I right in thinking that in the Pakistan constitution they do say that if there is a bilateral vote they will then give Kashmiris the vote?"

Before I post my response, here is the exact wording of the 'carrot' in question:

Article 257: Provision relating to the State of Jammu and Kashmir

"When the people of the State of Jammu and Kashmir decide to accede to Pakistan, the relationship between Pakistan and the State shall be determined in accordance with the wishes of the people of that State."

My response:

No, that is their spin. What is written is what should be read word for word in Article 257 of the Pakistani constitution. 

It is like saying, you must join us in order for us to allow you to be what you want to be. 

Any sane person would respond by saying that I'd rather be what I am without your interference and why should I take the risk of joining you in order to be what I already am?

Further:

Our State was independent before Pakistan invaded us in 1947 and dishonoured an agreement they made with the ruler (Maharajah), who made this agreement to protect his State's independence. 

The Pakistani invasion facilitated the Indian entry which was made under a fresh agreement with the Maharajah which the Indians did not follow through, blaming Pakistan for their interference.

Thus, the inhabitants were straight-jacketed by this British colonial designed railway track, whereby on one side of the track are Indian allegations against Pakistan and on the other side are Pakistani allegations against India. 

These mutual allegations and cross LOC firing have proved a ruse to solidify India and Pakistan's presence in JKA.

20% of the animosity generated between Hindus and Muslims led to India's division and 80% of the animosity generated by India and Pakistan amongst the inhabitants of Jammu & Kashmir has kept our territory divided, to the convenience of India and Pakistan and at our peril.  

This 80/20 railway track designed and implemented by colonial Britain in JKA needs to be understood in order to resolve this well-designed conflict; that immediately and ultimately benefited the United Kingdom, kept India and Pakistan relatively poor and ensured that the people of JKA enjoyed no rights whatsoever for 75 years.

Amongst millions of other issues 'The Democratic Deficit' should be a theme to discuss and address leading up to Pakistan's annexation attempt in the coming days. 

In my assessment it is the most critical deficiency in our people across the board at this crucial juncture of our history, from the public of AJK - at home and in the diaspora - to the members of the Pakistani Occupied Assembly in Muzaffarabad, essentially a growing city in the administrative province of Kashmir in a divided JKA. Which has proved to be not much more than a pretender to represent the political aspirations of the whole c. 85,000 sq miles of territory.

Now, it is high time that we begin cleaning our city Kotli according to 21st century methodology and not remain stuck in the 18th century. We will begin liaising with Luton Borough Council as of tomorrow.


- Official estimate of Luton's population in 2019 was 213,052
(Kotli city is around 150,000)

- Luton has c. 55% non-white population (including a significant amount of Kotlians, quite likely to be over 50,000)

- Luton has an industrial base and international airport (5th largest in the UK)

- Luton has significant Asian, African, Caribbean, Irish and Eastern European communities. 
 
- Luton Borough Council had a budget in 2019-20 of c. £575 million
(Kotli city's figure is yet to be clearly established)

From Luton and Kotli to Gilgit Baltistan. Pakistan is trying to do a Ladakh on this region. It will find that to be anything but plain sailing:

Daily Diary (DD) - Day 335 of 2021

Despite being at home and having ample time to move forward with all pending research work, there are still unavoidable diversions to tend to. For instance, if a distant relation pays you a visit......

I quite like the idea of the late V.S. Naipaul to lock oneself up in a room and put a notice outside to the effect of 'DO NOT DISTURB AT ANY COST', to put food outside and take empty plates away at appropriate intervals, until the particular tasks at hand are complete.

Meanwhile, just a few kilometres away in Shaheed Chowk Kotli, the JKLF (Toqeer Group) resumed its sit-in protest a few days ago, after a 10 day break to give time to the local administration to talk sense to the Pakistani clandestine agencies on the request of the local business community. However, the Pakistani agencies have yet to surrender and are facing heightened abuse by the locals at this most public of squares:

 

It is understood that the local Assistant Commissioner has informed the locals that the agencies are uncomfortable with the words 'Elaan e Azadi' (Declaration of Independence) in the literature. Of course, the hypocrisy of the Pakistani State is self evident, not least because they - the Pakistanis - tell the world that AJK is a self governing entity and effectively independent.

Daily Diary (DD) - Day 330 of 2021

After watching the following video yesterday I felt compelled to elaborate further on it, not least for its potential utility to help us clarify the constitutional status of Jammu Kashmir & Allied areas (JKA):


This video was an interview conducted by Syed Muzamil Hasan Zaidi - Managing Editor of Pakistan Now and the interviewee was Owais Anwar - Director of Research at the Research Society of International Law (RSIL) in Pakistan.

I will just transcribe some important parts of the footage, for possible current discussion and future reference.

Note: 
1) I have paraphrased some of the interviewee's sentences, including translation of some of the Urdu phrases he used.
2) I have made comments in brackets for clarity.
3) The time of that part of the conversation has been added for ease of reference.

What is the status of this 'thing'? 

(My note of clarification; The 'thing' he is referring to is the territory of Jammu Kashmir & Allied areas - JKA - n.b. I'm using the acronym JKA to simplify the territory in question without excluding any part of the erstwhile pre 1947 British Indian princely State)

Pakistan alleges that India is in Occupation of this territory. 

Occupation...Maqbooza Kashmir etc. has become a normal part of our language....it is a very legal term - an IHL term..a category of..international humanitarian law - essentially an occupation is a type of war...

..and what is its definition? An unconsented to..effective control...establishing control without permission...an unconsented effective control over a territory that you don't have sovereign title to....

(As an example) Title deed is what you have over your home and property...that is how it is your house...as you have that title deed..

Now...Say I come in and I kick you out of your house..I stay there..I've occupied it..as I have effective control over it...I'm not invited by you and I don't have sovereign title to this...I don't have title deed...it is not in my name..

It argues:
- (JKA) is an integral part of our territory..on account of Maharajah's accession.
- We then promised a plebiscite but the invaders never left 
- Then Kashmiris decided on joining us fully (viz. Constituent Assembly 1957)
- That ends matter but Pakistan is in occupation (of AJK and GB)

So, what is an occupation?
No sovereign title...Does India have sovereign title? They quote Maharajah's accession...but sovereign title does not shift until all link with the previous sovereign ends

...If I transfer title (over my house) to you, it only becomes your house when I receive all my money and go my own way..that never took place...the maharajah in the (alleged) instrument of accession (as India doesn't have a copy of the original) says....I retain sovereignty over many things (apart from defence, communications/currency & foreign affairs) and that I can go into any other agreement after this.

..so that is how India got permission to send its soldiers in and defend it against the tribal invasion (which the interviewee Owais Anwar describes as an act of defence against the Maharajah's brutal killings there)

..so sovereignty never shifted...even Mountbatten had put in a condition that there had to be a reference to the people and only then will this instrument of accession fully happen. So, this accession was never fully executed.

Is Indian army a hostile army? 
Yes...because that is the tool they are using to deny the local people their right to self determination. So, India exercises effective control.  

(Interviewer asks) What can we do (As in Pakistan?)

We can't do anything in the UN Security Council as India is diplomatically much stronger than us and we would likely face a veto from the US, Britain and France (as we previously saw with the Soviet Union/Russia)

ICJ (International Court of Justice)?
All routes to the ICJ has been closed by India...there are essentially 4 ways of taking it there..all blocked by India

Namely:
1) That we are commonwealth countries and cannot be adversarial in ICJ.
2) J & K is an internal matter.
3) Cannot bring up security issues at this forum. 
4) Cannot bring up matters of determining territory here.

These are (effectively) their (India's) terms for accepting the jurisdiction of the ICJ. India's terms have more weight than Pakistan at this forum.

Other option is getting an advisory opinion (which is not binding) but has weight because it has ICJ judges..

(political gamble there too? interjects interviewer) 

Indeed...again do you have enough votes in its General Assembly or any of the UN's special organs that have the authority to send a reference to the ICJ for an advisory opinion?

I thought it refreshing that a learned Pakistani was using reasonably neutral language to describe India and Pakistan's respective counter claims. I didn't agree with everything he said and noted some important omissions. For example, what doesn't give sovereign title to India is also what doesn't give sovereign title to Pakistan. 

In the context of my Pakistani flag lowering case in Dadyaal (21/08/2020) I contend that this discussion could provide important reference in due course.

Thus, I began sending the above video's link to a small number of co-citizens (legal experts, academics and activists) and a few foreign academics too who take an interest in this region's affairs.

This was my pitch to them:

I just want to be clear. Does Pakistan not have the same status as India in this equation and hasn't Pakistan taken similar steps to India in integrating the parts under it's control...political/constitutional wizardry, demographic change, bifurcation etc.?

I particularly liked, "We want to die for Kashmir but don't want to research it."

This morning I began receiving some responses:  

Manzoor Gilani 
(Retired Chief Justice of Supreme Court of AJK who also has the rare honour of having practiced law in Srinagar, Delhi, Islamabad and Muzaffarabad during his career)

The answer is now India has streamlined the parts of Kashmir in main land under constitution & made Kashmiris purportedly equal to Indians under threat of gun. 

It is negation of Indian independence Act, UNCIP resolutions, even against accession document and condition attached to it by Governor General and commitment of its leaders. 

People of Kashmir valley are 99% averse to Indian control by force, it makes Indian control an Occupation. 

Pakistan has also practically streamlined parts of Kashmir in its control but not under constitution and with out rights equal to other Pakistanis, however people here are not averse to Pakistani control but seek empowerment equal to other Pakistanis, pending resolution of issue, it is not Occupation.

India claims whole of the state as its part & has included it in constitution, but  Pakistan has not and does not, it has a political claim only under UNCIP resolutions; 

India does not accept UNCIP resolutions but Pakistan does, however it too has violated some  parts of it e.g. merger of Kashmir armed forces and absence of local authority. 

As for withdrawal of forces is concerned in case of plebiscite, both are responsible.

(whom I can't name at this stage to avoid complications)

Taking similar steps as India means that we have merged one part of the kashmir territory in Pakistan which is against the UNSC resolutions on Kashmir. This may have weaken our position on Kashmir. 

Secondly as far as the matter of demographic change by the indian side is concerned, as such this matter is not relevant to us as we have 100% Muslim population in AK.

Thank you for your informed response, although I think your second point about demographic change in AJK and GB may not hold water, as settling people of other nationalities in these territories still constitutes demographic change. Settling Muslims here gives India all the more rationale for settling Indian Hindus on the other side. 

This also makes this dilemma a political problem motivated by religion. Given that Jammu Kashmir & Allied areas are a multi religious territory in total, this renders the matter unsolvable. 

It also gives the impression to the wider international community that we want Muslim majoritarianism to apply here but demand equal rights for Muslims wherever they are minorities elsewhere. Thus, our humane arguments are rendered contradictory and self-fulfulling.

1) It has been 74 years, 3 months and 14 days since the Standstill Agreement between Jammu Kashmir and Pakistan.

2) It has been 72 years, 6 months and 30 days since the divisive Karachi Agreement between Pakistan and Azad Jammu & Kashmir (AJK).

3) It has been 74 years and 30 days since the conditional and limited accession between Jammu Kashmir and India.

4) It has been 73 years, 10 months and 11 days since the Indian government surrendered its accession document at the United Nations (UN).

5) It has been 844 days since India's (seemingly unilateral) action on the 5th of August 2019.

6) It has been 3 years, 5 months and 12 days since the office of the United Nations High Commissioner for Human Rights (UNHCHR) published its first human rights report on this territory.

The question is: What have 'Kashmiris' done during this period of time?

Just making demands to India and Pakistan is not the solution to the problem.

Neither is posting published statements of local newspapers in AJK - on social media - the solution.

Sitting down and putting our heads together for creating unified action is needed.

I know Indians and Pakistanis have diametrically opposite views on this subject but from an internal Jammu Kashmir & Allied areas (JKA) narrative; this interview has done much to clarify the concept of sovereignty of this territory. 

It is clear that no country holds sovereign title (title deed of ownership) to this territory and that every change that has happened since the 15th of August 1947 is conditioned or subjected to the people's reference (the local inhabitants as classified according to the state subject rules of 1927). This gives sovereign title to the people of this territory. 

Both India and Pakistan as well as the rest of the world should respect the local people's 'Right to Rule' and defer to them any possible future decision to accede or enjoy any other relationship with any other country. No country and indeed many of the people of this territory have not respected that fundamental, legal and constitutional right.
