Daily Diary (DD) - Day 63 of 2024

1200hrs:

Tragically missed out on yesterday's entry (Day 62 of 2024) as we've been without electricity for the past 24 hours. Whenever the weather takes a turn for the worse the first casualty is electricity. I did try my utmost to make something of the laptop screen but to no avail. I have to rely on a separate monitor to use the laptop and that is powered from the mains. 

It is gut wrenching to have missed out. It is even more gut wrenching to know that there were ways to avoid it if I had planned in advance.

I did sleep around midnight and did up early at c. 0800hrs but it remained difficult to get up and do anything given the pounding the surrounding environment had taken.

As we rapidly approach the most unique of football world cups ever in its history, we can rue our absence there and also try to enjoy the spectacle that it always presents:



I felt it appropriate to submit a comment too:

I think this has been a well presented programme. All the flaws were zeroed in and the viewer is better able to understand the achievement of Qatar to bring the most global of events in human history to its shores. 

We (civil society & public agency) in AJK (the 'free' part of Jammu & Kashmir) were not in a position to think 12 years ahead in 2010. Some of us who could have linked up the dots between Switzerland (Home of FIFA) and Qatar, were only beginning to work on obtaining FIFA membership for AJK & Gilgit Baltistan, during the final of the 2018 World Cup. Croatia also inspired us further by doing so well as a small country. 

Alas, 4 years was not enough preparation to get AJK to take part in a global spectacle of unparalleled exposure. We are yet to receive a response from FIFA in Zurich.

The thought of 'soft power' did go through my mind while watching the 2010 World Cup in South Africa, from AJK. I was happy for Qatar to have achieved this milestone. Hosting global conflict resolution puzzles and facilitating a global media channel are also examples of successful accumulation of 'soft power'.    

We in AJK and the rest of JKA will keenly follow Qatar's achievements into the future.

As is almost customary, the thought police of India and/or Pakistan will always try and address any mention of any part of Jammu Kashmir & Allied (areas) on any global forum. They will try and correct any information or analysis according to their own country's narrative. Such an example happened here too:

No, it is precisely these types of assumptions and assertions that have destroyed Pakistan. These are matters best left to the inhabitants of JKA, without external interference.

first of all, you mentioned Gilgit Baltistan. The people of Gilgit Baltistan have always wanted to remain separate from Kashmir and the overwhelming majority supports integration with Pakistan.
Second, if you really are Kashmiri, then you are disrespecting your ancestors and the people of Kashmir who fought and were ready to give their lives to make Kashmir part of Pakistan. 
You're definitely better off than the Kashmiris on the other side of the border.

I didn't think this would be the appropriate forum to discuss such matters but since you've raised them I'll just make a couple of brief points in the hope that you will agree to disagree, rather than continuing to pursue or clarify your 'ownership' credentials at the cost of the people of this territory, who have an inherent right to represent themselves, rather than a neighbour forcibly trying to represent their views to the world. 

You make assertions about Gilgit Baltistan while denying them basic fundamental rights for 75 years - which no-one stopped you from giving them. You restrict their freedom of expression, movement, assembly, association and deny them recourse to law and then make fantastic statements about them wanting to remain separate from Kashmir and that an overwhelming majority supports integration with Pakistan, without as much as a rudimentary public opinion survey to back up that assertion. It's a bit like Pharoah claiming that the children of Israel want to fully integrate with Egypt while denying them all avenues to express themselves or seek redressal for crimes committed against them.

The point about disrespecting ancestors also sounds ridiculous for a number of reasons. Anybody who fights for their rights and sacrifices their life does not do so with the intention of surrendering those rights to someone else. You maybe confusing blind faith with their co-religionists thinking that they would be helpful neighbours into a ridiculous suggestion that they sacrificed their lives for Pakistan. Most of the people who have died or been killed since 1947 is either because they found themselves in the wrong place at the wrong time through no fault of their own (religious minorities forced to migrate or be killed to validate the British created 2 nation theory), people who reside on the LOC being killed by Indian and Pakistani bullets, people in the Valley of Kashmir being killed for either being lured by Indian or Pakistani money and arms particularly in the late 1980's/1990's. The list is endless.

Finally, we may be better off than people on the other side of the border but Pakistan cannot take credit for that. Quite the contrary. Indian and Pakistani money and arms were used on the other side while no such intrigue took place on that scale on this side. An Indian wrong does not necessarily make a Pakistani right. The Pakistanis have foolishly tried to live off the misery of others thinking that it creates a groundswell of opinion in its own favour. Most of the world can see through you. Pakistan has closed our gateway to the world while it extracts resources mercilessly from our territory, forcing our people to migrate to all parts of the world for their livelihood. The conditions here are better because of our diaspora - whose foreign remittances enable Pakistan to continue surviving despite it being an economic debacle - and the Pakistanis know full well that if they try and repress our people like the Indians do, then it won't be long before they are kicked out of here. Pakistan does not have the diplomatic or economic clout of India to ride such tribulations.

As mentioned at the outset, I do not wish to continue using this platform to discuss matters that have nothing to do with it. You have made your points and I have made mine. Try and find me on an alternative platform if you're keen to continue the discussion. Try and represent yourself rather than others. Every human being is capable of representing themselves. Try to understand that.

Otherwise, organisations working as marginalised entities, factions, loose alliances and political parties operating under unnecessary and illegal restrictions for 75 years.

This is a hard - circular - route and fraught with unnecessary complications.

Organisations that want to address foreign presence in JKA using democratic, ethical, legal and peaceful means are crowded out from doing so and the people do not enjoy any civil protections in this regard.

Those civil protections need a codified (citizen's) charter inclusive of all and agree-able by the majority. That is only possible on the ground in AJK.

So, how do I engage with the public?

What are the terms of reference between the public and me?

On a specific political party platform that is not representative of the population and will not gain the required attention of the 'international community'?

Or do I engage the public as a whole and pursue a Public Assembly session (to prove representative political consensus) that will succeed in engaging the 'international community'?

Thus, we were late on 9 of the third 40 days (viz. 23% late) which is an improvement on 12 of the second 40 days (viz. 30% late), which itself was an improvement on 30 of the first 40 days (viz. 75% late)

1st 40 days -  75% late (30 of 40) 290 minutes deficit
2nd 40 days - 30% late (12 of 40) 214 minutes deficit
3rd 40 days -  23% late (9 of 40) 40 minutes deficit   

Total: 51 days late of 120 = 43% late!

By Day 80 we were 53% late, which was an improvement from being 75% late by Day 40 and now we have improved further to bring our ratio of late days down to 43% overall.

In short, we still have room for improving our punctuality further despite our incremental gains, especially since Day 50 when we had accumulated a punctuality deficit of 580 minutes and a late ratio of 76%.

My punctuality surplus has decreased to 26 minutes. 

Being 38 seconds late is still late and has to be recorded as such. There is nothing more powerful and eternal than truth. The last time I was late was on Day 242 of 2022 or Day 86 at the Square or 19 days ago. The bright side is that this has been our most punctual consecutive run to date. 

Punctuality percentage: 59 days on time or early of 105 = 56% punctual.

We have decided to review our performance and interaction over the preceding 4 days, on every 5th day. This will - amongst other features - give our listeners breathing space to digest the various aspects of public policy:

Daily Diary (DD) - Day 241 of 2022

My punctuality deficit has increased to 183 minutes.

Punctuality percentage: 44 days late of 85 = 52% late

One thing is certain. Whenever I have to travel out of Dadyaal the odds of me being late the next morning increase exponentially. It is remarkable that the gains I made yesterday morning were cancelled out precisely today. That is, I arrived at 0717hrs yesterday and thus decreased my punctuality deficit by 43 minutes. Today, I was precisely 43 minutes late!

For those of you who are unfamiliar with my work it is important to understand that I have spent 85 days in a row - without a break - between 0800hrs and 1000hrs at Maqbool Bhat Martyr's Square in Dadyaal. Unfortunately, I have not been punctual on every single day and thus am trying to close the punctuality deficit by arriving earlier than 0800hrs, at every opportunity. I have managed to peg back the deficit from a low of 580 minutes to what it is today viz. 182 minutes.

It may even be in order to make a comparison between the number of days that I've been punctual versus the number of days I haven't:

Public Policy in AJK connecting with the world's experts in the subject at the London School of Economics:

I am sending my co-citizens this link at a critical stage of our journey towards nationhood and statehood in AJK and ultimately JKA. The 'London School of Economics' describes itself as the world's best institution for the study of Public Policy.

We now have an opportunity to enrol on an online course in our favourite and most appropriate discipline. It is also an opportunity to test our technical aptitude in this subject and compare our on-the-ground experience of 17 years and 5 months with the best of what's available in the world.

The cost to the public: c. $1,300 (US dollars)

We would also like to take this opportunity to give a broad outline of what is required from our people to design and develop a world class system of governance in AJK:

Manpower: 
1,771 - human/data management professionals

Annual Budget:
£20 million (Pound sterling) or equivalent to c. 5 billion PK rupees.

*We are converting at the rate of 250 PK rupees to the pound for simplicity. The actual rate today is c. 258

The past 75 years of occupation/administration/control by others of JKA, connected to the prevailing absence of governance in AJK coupled with the naked priorities of self interest prevalent within our public, may suggest that the broad outline given above is impractical or even illegal.

Practicality:
There are over 5 million people living in or from AJK. At least 40% (over 2 million people) of them have at least a middle-class standard of living or live above subsistence level. What we require is for 100,000 of them to pay a voluntary tax of £200 or c. 50,000 PK rupees in a year. Which amounts to less than 55 pence or less than 137 PK rupees a day.

Legality:
It should be common knowledge amongst our people that JKA is not legally or constitutionally part of any other country. The British Indian empire did not transfer suzerainty or sovereignty of this territory to any other country and neither did they retain it themselves. Furthermore, all the countries that claim or monitor this territory have conditioned their presence or involvement on the local people's reference. It is also clear that these inhabitants hold title to this territory. The Srinagar/Jammu Assembly doesn't exist in practice and the Assemblies in Gilgit and Muzaffarabad do not conform to international law (or the UN template on this region) and are not even recognised as an executive authority by their sponsor Pakistan. 

Thus, we - the people - are the masters of our own destiny. We have been waiting for the world to help us and we never gave serious thought to help ourselves or more appropriately, each other.

We have little time to waste and obviously this governance initiative cannot be implemented by force. The most this action-oriented researcher can do is publicly list those co-citizens who are familiar with this struggle for freedom & world class governance and have the means to finance it, yet deliberately refuse to do so. 

History will be their judge and ours too.

At this stage we will forego the description of him as a Pakistani, which he legally and constitutionally isn't. Nevertheless, pursuing his release tirelessly is a significant gesture of goodwill, on the part of Rahul Kapoor in particular.

Today was also 'Meeting the AC' day. Regular followers of this weblog will know that we like to keep our local administration and municipality engaged with all developments at Maqbool Bhat Martyr's Square. The following letter explains to the Assistant Commissioner (AC) that even at this late stage of the gardening season we would still like the administration and municipality to play a part in financing the beautification of the Square. They are always welcome to aid us in cleaning and gardening too.

Here's the latest written communication: 



Note that the last time we communicated was on August the 3rd. That was the 4th time since we began communicating on the 15th of June. Hence, the above is communication exhibit number 5.

However, the AC 'explained' that the municipality doesn't have any money and that we are welcome to do whatever is necessary to beautify the Square. We have promptly forwarded his written remarks to the municipality.

In the meantime, the president of the trader's association in Dadyaal, namely Anwar Daar has assured us that he will obtain a written MOU (Memorandum of Understanding) from the AC. Meanwhile, he suggests that we continue public funding to pay for the metal grills that we need to fortify the Square from animals.

This is my latest arrival yet and it is partly to do with my venture out to Tithrinote yesterday, for the 3rd time in 6 days. We did arrive back in Dadyaal by c.0100hrs but I couldn't sleep until beyond 0400hrs..

We did warn our people in the early hours of yesterday and also alerted global civil society. We received positive feedback too and then this happens in Rawalakot this evening:

I was trying to get hold of Saddaqat Mughal Kashmiri of Athmaqam in the Neelam Valley yesterday afternoon. In the evening he was picked up by the local police who enticed him to SP Neelam's residence, ostensibly to talk about the murder case of Haseena Bibi. They allegedly passed him on to Pakistan's clandestine agencies, who effectively abducted him to an unknown location. 

We later found out this morning that he's in City Police Station Muzaffarabad.

 

Just a day before he was abducted he shared the following post in Urdu, on his Facebook wall:

I don't know why I feel that Brigadier Mehtab will get me killed.

Anyway, death is a reality.

If I am martyred at his hands while struggling for the freedom of my country and nation, then what could be a bigger fortune than that?

To add context reference Brigadier Mehtab: 
Apparently he is a Pakistani military brigadier serving in Neelam and a couple of weeks ago he had urged or warned some members of the public - reportedly at the Deputy Commissioner Neelam's office - to ensure that the public boycott or stay aloof from Saddaqat Mughal. That the latter was a traitor and so on and so forth. In reaction, Saddaqat Mughal turned the screw in public about the Brigadier's reprehensible conduct in our territory and questioned the latter's authority and morality to engage in such vile propaganda.

Here's a statement publicly asking Brigadier Mehtab the cause of his fear, which featured in a newspaper as well as on his Facebook wall for the 1st of July:

This alert has been forwarded via Public Agency and it is immediately learned that Saddaqat Mughal Kashmiri is in City Police Station, Muzaffarabad, where the public is gathering to ensure he is not further abducted to Pakistan. 

It is important that he is kept there until release. 

We have decided to ask Quayyum Raja or anybody he deputes to negotiate with whoever comes forward in Muzaffarabad for his release as soon as practical. 

As Public Agency it is important that from a security and human rights perspective we immediately identify who ordered his kidnap and what do they want?

It is for the public of AJK to then demand negotiation via Public Agency (and Public Assembly if necessary) to identify constitutional, legal, political and administrative parameters for future reference. 

Remember, according to a recent post by the globally renowned Kashmiri jurist and expert on UN involvement in JKA Dr. Nazir Gilani (and I paraphrase for wider clarity) the state subjects (aspiring citizens) of this territory hold title to this territory and not India, Pakistan or any other political entity. 

They and others can be considered claimants and we are open to assess their merits, given a level of freedom of expression that would have to surpass what India, Pakistan, China or the UN have offered the titled inhabitants since 1947.

I have been asked to negotiate the release of a Kashmiri leader Sadaqat Mughal. 

The first thing the police must do is to produce Sadaqat Mughal in court, so that the court can determine if he has committed any crime. 

It is not acceptable that police has acted as a result of an order from above. The public and accused must know who has ordered and why?

The police must follow the procedure and not hand him over to Pakistan. 

Sadaqat Mughal belongs to this neutral territory and the law of this territory should be respected.

مجھ سے کہا گیا ہے کہ کشمیری رہنما صداقت مغل کی رہائی کے لیے مذاکرات کریں۔

 

پولیس کو سب سے پہلے صداقت مغل کو عدالت میں پیش کرنا ہے، تاکہ عدالت اس بات کا تعین کر سکے کہ آیا اس نے کوئی جرم کیا ہے۔

 

یہ قابل قبول نہیں کہ پولیس نے اوپر کے حکم کے نتیجے میں کام کیا ہو۔ عوام اور ملزمان کو معلوم ہونا چاہیے کہ حکم کس نے دیا اور کیوں دیا؟

 

پولیس کو طریقہ کار پر عمل کرنا چاہیے اور اسے پاکستان کے حوالے نہیں کرنا چاہیے۔

Sadaqat Mughal

JKCHR welcomes the fresh directions issued by Chief of the Army Staff (COAS) General Qamar Javed Bajwa to all his commanders and key officers, including those associated with the Inter-Services Intelligence (ISI), to stay away from politics and avoid interacting with politicians.

There is another habitat called AJK. Directions by Army Chief should be issued in that regard as well. Interference should end in AJK and roles should be in accordance with responsibilities assumed under UNCIP Resolutions.

We are concerned about the arrest of Sadaqat Mughal, a resident of Neelum. He heads a splinter faction of JKLF. 

Sadaqat Mughal had earlier voiced his grievance against an officer of Pakistan Army. The arrest should be transparent and a matter for the civil administration.  The army officer has a ‘higher burden’ of responsibilities.  He has to conduct himself as an “ambassador” of an institution and remain as an example while in Azad Kashmir.
 
The area has a history of abuse of power and activities in violation of law.  We urge that there should be an end to this carried forward abuse of authority. These actions are a violation of the duties assumed under UNCIP Resolutions.

We urge for an early release of Sadaqat Mughal.    

There should be a due process of law.

Update at 2100hrs:

There is yet to surface any evidence of Saddaqat Mughal being detained under any legal provision. Meanwhile, he has been shifted from City Police Station in Muzaffarabad to Garhi Dupatta Police Station about 23 kilometres away.


Sources do inform us though that he is being detained in a room and not a cell at the police station. He has been given a 'kat' (bed) to sleep on. Such antics to shift prisoners is to counter the attention of the public, who usually gather in numbers when such controversial abductions/arrests are made.

A letter has been posted to the Federal Interior Minister of Pakistan by Zahoor Ali in Bradford UK, seeking Saddaqat Mughal's immediate release.

Inside sources inform us that the defenders of the Pakistani State - aided by their pliant accessories in AJK - have been trying very hard to break Saddaqat Mughal's will but without any success. 

We think this is the most pathetic manner of trying to run a government in the 21st century, which even an infant would not buy.

That is, abduct someone and keep that person in your custody until you break their resolve. Narrate some fairy tales about your supposed commitment to Islam and how you represent the Muslims of the Indian sub-continent. It shouldn't matter that you habitually lie and cheat with those who pay you (taxes) to serve them, extract resources to maintain lavish lifestyles at the cost of the environment, exploit the weak and needy at will and deprive them of justice at every opportunity. 

How can fellow humans trust those who repeatedly try and make a fool out of the creator of human beings?

Is Saddaqat Mughal being punished to satisfy the ego of a Pakistani Military Brigadier who appeared overly keen to ensure the inhabitants of the Neelam valley remained subservient to the Pakistani narrative? 

Or is he being taught a lesson for pursuing justice for the alleged murder of Haseena Bibi by her in-laws, who were allegedly aided and supported by the rotten local administrative/political structure in the Neelam Valley?
