Daily Diary (DD) - Day 311 of 2025

1220hrs:

Countdown to end of 2025: 55 days

It gets worse before it gets better is how I feel. Today, I have found myself 7 hours behind schedule. I may have only slept 6 hours which is the average I am getting of late but I didn't get to sleep till 0400hrs (an hour after the time I am supposed to be waking up!) and got up at 1000hrs.

....

This is a young man who could have emerged as a genius for this State but personal problems and particularly a failed marriage at a young age shook him to the core. He has been in a disturbed state of mind and has been missing from his abode of Khwaja Seri, near Sharda for over 4 months.

He was last reported to be seen in the vicinity of Bagh and Rawalakot and there is a possibility that he may even have crossed the LOC/CFL at Tithrinote. Citizens on either side in these areas are asked to report any citing or knowledge of his whereabouts.

This message is reproduced here on behalf of his family and well wishers.

....

Here is a guest article from my somewhat estranged Kashmiri Pandit brother:

Kuldeep Pandita of Rainawari Srinagar

(Living in enforced exile in Chennai Tamil Nadu India)

Azadi’s Shadow
The Myth of Sati Sar, Camouflaged Realities and Kashmir’s Militant Struggle

The myth of Sati Sar—created by Lord Shiva for his wife Sati, later reborn as Parvati—symbolizes divine union and cosmic harmony in Hindu mythology. Shiva’s act represents cosmic order, and Sati Sar stands for the sacred connection between divine powers. Yet, the story’s paradox arises when a revered sage, Kashyap, is said to have violated or drained the lake—an impossible affront given Shiva’s supremacy. This contradiction suggests that this element is symbolic, a crafted narrative to address dissonance within the myth.

To justify the violation, myth-makers introduced a demon who seized the lake, plunging it into chaos and necessitating Shiva’s fierce intervention to restore order. This demon is not a mere historical fact but a narrative device playing on humanity’s deep-seated yearning for moral clarity—the “pleasure and obsession with goodness syndrome.” Across religions and cultures, the production of demons or asuras serves to legitimize divine authority by emphasizing a cosmic battle between good and evil.

Without such figures, religious doctrines lose the ability to frame ethical struggle and spiritual triumph. This dynamic has powerful analogues in modern political landscapes—none more relevant than the militancy that gripped Pakistan-Occupied Kashmir (PoK) in the 1990s.

The militant insurgency disrupted peace, much like the mythological demon disrupting the sacred lake. This “demon”, armed with ideology and violence, sowed chaos and fear, eroding the hopes encapsulated by the promise of Azadi ("freedom"). Yet, the state response—reasserting control over northern Kashmir by raising barriers and fortifications—mirrors Shiva’s restoration of order by raising a protective mountain wall around the sacred waters.

In reality, the militancy in PoK was deeply camouflaged by narratives of liberation and justice, but beneath lay strategic interests—Pakistan’s desire for depth and leverage rather than a genuine quest for freedom for Kashmiris.

The echo of this political camouflage resonates with global movements where ideological fronts mask complex realities—Arab Spring’s omitted Islamist undercurrents, India’s layered 'Quit India' movement, or the 'Black Lives Matter' movement’s evolution from symbol to broad systemic reckoning.

Similarly, PoK’s claim to Azadi under the euphemism “Azad Jammu and Kashmir” cloaks a curated reality of settlements, curfews and silenced voices. The scale of conflict and control dwarfs idealistic appeals. As in global agitations, millions are mobilized not by nuanced truth but by powerful, simple narratives—lies or camouflaged truths felt viscerally by crowds.

The draining of Sati Sar by Kashyap and the demon’s oppression allegorize the leakage of hope in PoK, where fears and power games outvote ethics. The military’s containment of militancy is the reversal of Kashyap’s violation—restoring Shiva’s will in a tangible form. It isolates and neutralizes the demons who infiltrate, raising barriers analogous to the mythic mountain walls, pushing back darkness with force. Thus, the mythic and the real intertwine.

Myths do not merely recount history or preach morality; they mirror enduring human conflicts—between order and chaos, truth and camouflage, hope and fear.

PoK’s struggle, seen through this mythic prism, challenges us to reckon with the harsh scale at which ideas operate, the cost of camouflage and the complex dance of reality and myth in shaping human destiny. In confronting this, the question remains daunting: to abandon mythic idealism in favour of cold realism, or to forge from both a truer fire that can truly liberate. Until then, silence sustains—and the demons linger.

Daily Diary (DD) - Day 128 of 2024

2329hrs:

Fared today similar to yesterday viz. midnight to 1000hrs....thus I need to work out what is preventing me from waking at 0500hrs as I was doing not long ago.

Daily Diary (DD) - Day 23 of 2024

1017hrs:

Performed slightly better than yesterday, sleeping at c. 0200hrs and getting up at c. 0930hrs. Practice makes progress and finally we will get it right. One can judge from the stats generated during my 297 day stint at Maqbool Bhat Martyr's Square (2022-2023) how I managed to ensure punctuality to over 90% in arriving at the Square at 0800hrs, whereas in the beginning I was struggling at below 60%.

....

It just so happened that today's working schedule coincided with potentially highly inflammatory news emerging from India. Meanwhile, here's a construction more closer to home that we wish to give attention to. We also hope our diaspora can give attention to this educational initiative for our future generations:

Here's the related video in Pahaari:

....

It all began a couple of days ago. Google alerts began informing me of wide coverage in Indian media about me sending holy water (sacred to the Kashmiri Pandits) of Sharda for the re-opening of Ram Mandir in Ayodhya, Uttar Pradesh, India yesterday.

I began clarifying my position yesterday when many ill-informed bigots in AJK began claiming to defend Muslims - and no less - Islam by criticising me, abusing me and even threatening me for not only selling my nation but selling my religion too. Here's a screenshot of one such threat emanating from a journalist Shahid Choudhary of Dadyaal, apparently politically affiliated to the Pakistan People's Party as well as the Jamaat e Islami.

A video statement at Jammu Chowk Sehnsa was also in order, to read out JKA PUBLIC AGENCY NOTE #U214822012024 and also the above Facebook post by Shahid Choudhary as an example of how propaganda operates here in AJK whenever it recognises an opportunity:

Daily Diary (DD) - Day 295 of 2023

1418hrs:

This day in 1947 was probably the darkest day in the history of this territory. I am featuring a Facebook post today from a Kashmiri Pandit - living in exile in Chennai (formerly Madras) in India - who has his own inimitable style of communication:

Daily Diary (DD) - Day 345 of 2022

1058hrs:

Day 189 at Maqbool Bhat Shaheed Square - Dadyaal.

0800hrs

Attendance = 100%
Punctuality = 66%
124 days on time or early of 189
Punctuality surplus = 33 minutes
Punctuality Consistency Status = 5 days

Note: Today's photo was taken inches away from the Square, to avoid any disruption to our punctuality. As intimated in earlier posts, for the past few weeks I have been meaning to walk to the Square from home, rather than hitch a pillion ride on a motorcycle or a lift in a car. In that I have succeeded, thereby improving the qualitative aspect of my punctuality at the Square.

The following report was published by Dr Nazir Gilani - renowned jurist of UN template on Jammu Kashmir & Allied (areas) - about a week ago. Such is my 18 hour day that I have just today pounced on the opportunity to reference it, despite its more immediate merit:

There are many relevant points for all those interested in JKA but the following extract is relevant for our Twitter Space today:

Dr Nazir Gilani has referenced the Maghar Singh Case (J & K High Court May 1953) on Pages 24, 25 and 26 of his December 2022 Report 'Indian Action of 5 August 2019: Jurisprudence of Kashmir Case'

Here's the exact text he has written:

(Page 24 below)

Residuary Sovereignty of the State

Locally the leadership of Indian Administered (now occupied) Jammu and Kashmir (and even the leadership of Azad Kashmir and GB) could challenge the Indian action as a breach of the terms of ‘provisional accession’. These terms of accession have been fully examined in the Maghar Singh case by Janki Nath Wazir CJ and Shahmiri J of the J & K High Court in May 1953. Commenting on the status of the Accession the judgement reads:

[(c) While the Maharajah of Kashmir was under the Paramountcy of the British Crown before the partition of India from 15.8.1947 under Section 7, Indian Independence Act (10 & 11 Geo VI Ch.30) passed by the British Parliament suzerainty of His Majesty over the Indian States lapsed and all functions exercisable by His Majesty at that date with respect to the State of

(Page 25 below)

Jammu and Kashmir, all obligations of His Majesty towards the Jammu and Kashmir State or the ruler thereof and all powers, rights, authority or jurisdiction exercisable by His Majesty at that date in relation to the State of Jammu and Kashmir by treaty or otherwise lapsed and the State became an independent and sovereign State in the full sense of the International Law. Thus whatever limits to the sovereignty of His Highness in relation to matters coming within the sphere of paramountcy existed before 15.8.1947, these ceased to exist and His Highness became an uncontrolled and absolute sovereign even in relation to such spheres from that.

Now let us examine what was the effect of the execution of the Instrument of Accession by his Highness on 26.10.1947. This Instrument of Accession which was executed by the Ruler of the independent and sovereign State of Jammu and Kashmir was executed by him under Section 6, Government of India Act 1935, as adapted by the Indian (Provisional Constitution) Order 1947. By executing this Instrument of Accession the Ruler on behalf of the State acceded to the Dominion of India with the object that certain authorities specified in Section 6 (1) (a) shall by virtue of the Instrument of Accession, but subject always to the terms thereof; and for the purposes only of the Dominion, exercise in relation to the State such functions as would be vested in them by or under the Act.

It is clear that, even if the Instrument of Accession had not made any specific reservations therein, the Instrument read with Section 6, Government of India Act would leave the residuary sovereignty of the State entirely unaffected. But the Instrument of Accession does not leave this important matter to be determined by implication alone.

Clause 8 of the Instrument of Accession runs as follows:

“Nothing in this Instrument affects the continuance of my sovereignty in and over the State, or, save as provided by or under this Instrument, the exercise of any powers, authority & rights, now enjoyed by me as Ruler of this State or validity of any law at present in force in this State.”

“In view of this clear and express reservation we see that no change whatsoever was affected in the residuary sovereignty of the State or the power of the Ruler so far as the succession of the State to the Dominion of India was concerned.”

The division bench in Magher Singh v Principal Secretary J&K Government case has examined the status of Article 370 and said “A careful examination of this article would show that it in no way altered the basis of relationship between the State and the Union of India. The residuary sovereignty of the State and the powers of its Ruler in matters other than those specified in the Instrument of Accession remained unaffected. The purpose for which Article 370 was incorporated in the Indian Constitution is clear from the language of the article itself. This is also apparent from the speeches made by the prominent members of the Government of India who were responsible for drafting this article and piloting it thorough the Constituent

(Page 26 below)

Assembly. On 12.10.1949 this is what the late Sardar Patel, Deputy Leader of the Congress Party, Deputy Prime Minister and the Minister for States said in the Constituent Assembly on this Subject:-

“In view of the special problem with which the Jammu and Kashmir Government is faced, we have made special provision for the continuance of the relationship of the State with the Union on the existing basis.”

The most recent examination of the terms of a relationship with India has been carried out in The State Autonomy Committee report published in July 2000. On 29 November 1996, the State Government had set up a Committee to examine the question of restoration of autonomy to the State of Jammu and Kashmir. The 9-member Committee was chaired by Dr. Karan Singh. It has made clear that Jammu and Kashmir had agreed to a limited relationship on three subjects and the State has never merged with the union of India. This report was adopted by both houses of the J&K Assembly.

End of excerpts in relation to Maghar Singh Case (J & K High Court May 1953)

....

As an aspiring citizen of a neutral Jammu Kashmir & Allied (areas) - JKA I tend not to commentate on the internal affairs of any of my neighbouring countries, partly in a bid to set them an example to stop interfering in what are essentially our matters.

However, since I've been repeatedly invited to comment on this paper I would just highlight the following:

1) The whole idea of Pakistan's creation (to supposedly defend Global Islam in the shape of a fortress after the idea of defending Indian Muslims wasn't found appealing enough to Indian Muslim voters) was and continues to be a hoax.

2) The Pakistani State has almost carte blanche to do whatever it wants to its citizens and even its neighbours as long as it doesn't interfere with the larger scheme of global geopolitics, which Pakistan has been designed to be subservient to. Likewise, it can spend whatever it receives from foreign donors or benefactors in whatever way it likes, subject to any conditions set by these donors and benefactors.

The list of countries that Pakistan has been created and designed to benefit at the cost of all humanity living in its neighbourhood has increased over the decades. While the moral compass of all those of its citizens oblivious to all above factors, continues to sink.

The example that you have given in this paper is a mere symptom of this figment of British colonial imagination called Pakistan.

There had to be an update on JKTV too:

....

I realise that today - Day 40 at Shaheed Chowk - is auspicious on more than one front. The following message in Urdu reminded me:

اللہ پاک شب معراج کے صدقے ہم سب کو صحت وتندرستی عطا فرمائے زندگی و آخرت میں کامیابی عطا فرمائے آمین

Translation:

May Allah bless us all with health and strength on account of Shab e Miraj (literally translates to the Night of Ascent. It refers to the incident of Isra and Mairaj when the Prophet Muhammad (PBUH) was taken to the heavens and brought back overnight during his lifetime). May Allah bless us with success in this life and the hereafter. Ameen.

End of translation....

....

It was truly heartening to see and hear my comrades Baba Jaan of Hunza in Gilgit Baltistan, Imran Shan and Ilyas Khalid (both) of Dathote in Union Council Paachot in Rawalakot voice their solidarity for my 'Public Policy Workshop' at Shaheed Chowk Kotli:

....

Here's a thoughtful write-up by a young public rights activist in Hajeera:

Social contract and Awami Action Committee

Sardar Mohsin Mumtaz

There are countless taxes - including fuel adjustment - which you might see on your utility bills. On the other hand there is a tax on the purchase and sale of mobile phones, property taxes and hundreds of such other taxes which we directly pay to the State.

The question is, what does the State give in return?

We have to directly purchase everything from education to health facilities, including even a sachet of Disprin, with our own money. Justice is expensive too, which for the most part is out of the reach of the common people of the State. A respectable citizen is frightened even to walk passed the police station.

Then where are our taxes utilised?

There are 53 MLAs (local members of the legislative assembly, 6 lent officers from Pakistan, 3 DIGs (Deputy Inspector Generals) and 3 Commissioners in 3 divisions of AJK, 10 Deputy Commissioners in 10 districts of AJK, 32 Assistant Commissioners in 32 subdivisions of AJK, up to 150,000 government employees in total. There is more yet. 'We' also have a battalion of ministers. All the aforementioned are enjoying their status on taxes raised from our masses.

They have all failed thus far to work for the welfare of c. 5 million people of our State, of which possibly as much as 2 million are in the diaspora world-wide, many of whom regularly send much needed foreign exchange in the shape of remittances, which aid the Pakistani State to keep their country economically afloat.

There is a burgeoning question mark on the existence of this battalion of 'public' servants.

Do you fear to raise questions about your rights?

Are you not raising your voices because you think you will be murdered?

Then listen my dear co citizens!

Graveyards are full of people who were afraid of death.

This paradise on earth has been converted into a hell for our people, by the oppressors and their facilitators.

Raise your voices against them, write against them, come out onto the roads and play your due role.

All political parties - in subdivision Hajira of Poonch district - have established by consensus Awami Action Committee against the brutalities, exploitation, looting and plundering of the resources of AJK.

I urge the people of AJK to establish identical forums in their respective subdivisions too, to counter the lawlessness prevailing in AJK.

End of write-up....

Daily Diary (DD) - Day 19 of 2022

2144hrs:

Of course, I am primarily consumed with the Malik Waseem case. This is their third day out in the cold. I felt a lot of anger inside me for 'allowing' this to happen. One always feel there is more that they could have done to prevent matters from getting this far.

In my morning conversation with him it became clear that mounting pressure is developing on him by the administration to make a 'deal' but his response is that why isn't his adversary given a 'deal'? Why is he being uprooted?

He also has the answer.

There is a new judicial complex being built nearby and that has increased the value of Ratan Singh's land. Land speculators want him out first, knowing that he and his family will resist - and is resisting - and they also know that the other members of the community may not put up such a resistance on their turn. It should be remembered that this is 'evacuee property'. It cannot be sold or commercialised - its occupancy can only be interim - until the evacuee's descendants return or some other amicable solution is arrived at, to the satisfaction of the people of Jammu Kashmir & Allied areas. The Indians played ball on 'evacuee property' on that side until the 5th of August 2019 - in general - and as far as one has gathered from anecdotal evidence thus far. However, demographic changes are apace there now, we are informed.

In short, the 'big fish' want to gobble up the 'small fish' without mercy. The classic contest between strong and weak is in full flow.

This is why the Commissioner of Muzaffarabad Masood ur Rehman (remember him? does Mahmood Musafir ring a bell?) cannot agree with Malik Waseem's story, as pointed out in yesterday's weblog entry. Apparently, some bureaucrats and members of the judiciary have already worked out how much and who is going to benefit from this land grab.

The original Sikh owners are nowhere in the picture. The claiming adversary of Malik Waseem lives in the UK and will profit from acting as proxy. Someone needs to interview him, if possible.

Meanwhile, it may be notable to add that Malik Waseem's father Ghulam Qadir and his paternal uncle Wali Muhammad are retired soldiers of the Pakistani army. They have both appealed for help, protection and justice. In a sea of drowning hope, they have both made a plea to the Pakistani army to intervene:

Father Ghulam Qadir

Uncle Wali Muhammad

Coverage of Waseem's family issue has expanded to various platforms on social media. Here's an example:

AJK Point (media channel in Muzaffarabad) also made a thoughtful video which cannot be embedded for some reason, despite several attempts. (You can click the hyperlink 'embedded' in the previous sentence to access it though.

In the evening I called Sardar Shameem Sahaab for an emergency meeting on Malik Waseem's issue. Here's a summary of the conversation:

It seems the pressure on Waseem from various quarters has forced him to retract or clarify his statement about India's prime minister. Who else but Irfan Ashraf (remember him from Tehreek e Jawanaan vs. JKNSF in Kotli?) to provide the platform:

Most of us will be able to add 2 + 2 together above.

.....

As we are on the subject of enforced migrations, let's find time to also explore the plight of the Kashmiri Pandits:

.....

Let's change the subject now, or at least some of it. I thought the following Dogri song was striking, inclusive and our geographically distinct identity was clarified. Well done!

Me kali Kashmir di they Jammu da Ghulab da:

I did check the whole video on YouTube. The channel had a distinctly Indian name and the rest of the video had very different themes. This segment took on the national question in a very creative way. For example, she says Pakistan and China dream of it and this is neither Delhi or Punjab! (She couldn't say India for obvious reasons, so the creativity in lyrics was smart. Saying this is not Delhi is effectively giving the same message). Dogra museum and I think the Tawi bridge in the background. Claiming ownership of both Jammu and Kashmir was also interesting I think.
