Although I did get up at around midday, I didn't go to sleep till around 0400hrs.

Nationalist groups in Azad Kashmir

To critically assess the position of the nationalist groups in Azad Kashmir, it is essential to recognize that their internal fragmentation and lack of a unified vision undermine their capacity to propose a credible alternative to the United Nations (UN) framework. 

The ongoing splintering of these groups raises questions not only about their legitimacy but also about their ability to offer a coherent, sustainable solution to the Kashmir issue. Before any departure from the UN framework can be entertained, these groups must first demonstrate their ability to unify, create a compelling vision, and present a feasible plan that can engage not only India and Pakistan but also the international community, particularly UN member states.

1. The Challenge of Unity: Legitimacy and Representation

The nationalist groups in Azad Kashmir are far from united. Their fragmentation into multiple factions with differing ideologies and visions for the future of Kashmir weakens their ability to project a coherent and unified narrative. This disunity raises a fundamental question: if these groups cannot agree among themselves on basic principles, how can they credibly claim to represent the diverse aspirations of the Kashmiri people as a whole?
In a conflict as complex and entrenched as Kashmir, unity is not merely a political nicety; it is a prerequisite for legitimacy. A fragmented political landscape weakens any attempt to engage in meaningful dialogue with India, Pakistan, or the international community. To be taken seriously, these groups must first show they can overcome their internal divisions and present a common, coherent platform that reflects the interests of the Kashmiri people. Without this unity, their proposals risk being seen as self-serving or reflective of a narrow agenda rather than the collective will of the people they claim to represent.

2. The Need for Credible Symbols of Authority

Beyond unity, nationalist groups must also establish credible symbols of authority that can effectively engage with key stakeholders, including India, Pakistan, and international actors. The ability to communicate and negotiate with these parties requires a robust political structure that commands both internal legitimacy and international recognition.

In practical terms, this means that these groups must not only present a unified vision but also demonstrate that they have the institutional capacity to manage the political, economic, and social complexities of Kashmir. They need to have mechanisms in place for governance, the protection of human rights, and the resolution of internal disputes. These groups should offer a clear political framework that details how they intend to engage with India and Pakistan, ensuring that their efforts are seen as credible by the global community.

Without such symbols of credibility—be they through formal political bodies, democratic processes, or international diplomatic channels—the nationalist factions risk remaining marginalized in the broader political discourse. This lack of institutional maturity and authority will hinder their ability to form meaningful partnerships with other states and organizations, ultimately limiting their capacity to negotiate a lasting solution.

3. The UN Template: A Pathway to Inclusivity and Dissent

The United Nations framework, shaped by years of international diplomacy and legal deliberation, offers a structured approach to resolving the Kashmir dispute. The core principle of the UN's involvement in Kashmir is the right of the Kashmiri people to self-determination, exercised through a UN-supervised plebiscite. This framework has the broad support of the international community, providing a neutral, internationally recognized mechanism to address the competing claims of India, Pakistan, and the Kashmiri people.
The beauty of the UN process lies in its inclusivity—it ensures that all parties, including dissenting voices, are heard and respected. It acknowledges that the solution cannot come from one side imposing its will upon the other but must be a product of dialogue and mutual recognition. The process of self-determination is thus built on the foundation of respecting differences and ensuring that no group is marginalized.

Given this, any nationalist group seeking to deviate from the UN framework must propose an alternative that matches or exceeds this level of inclusivity and fairness. They must provide a solution that not only satisfies the aspirations of the Kashmiri people but also accommodates the legitimate concerns of India and Pakistan. Crucially, any alternative must involve mechanisms for peaceful coexistence, respect for dissent, and the protection of human rights for all communities in the region.

4. The Burden of Constructing a Credible Alternative

If the nationalist groups are to move away from the UN framework, they must demonstrate that they have a well-defined, practical, and internationally acceptable alternative. The burden of proof falls on them to:

• Present a Unified Vision for Kashmir’s Future: 
A fragmented political landscape weakens any argument for departing from the UN process. These groups must demonstrate their ability to come together and craft a vision that reflects the aspirations of the Kashmiri people as a whole. This vision must be inclusive and forward-thinking, addressing the needs of diverse communities, including ethnic, religious, and political minorities.

• Create a Legal and Constitutional Framework: 
The UN's involvement in Kashmir has always been framed within a clear legal and constitutional framework, one that recognizes the principle of self-determination and ensures that the rights of all parties are respected. Nationalist groups must show that they can offer a robust legal alternative that guarantees these same principles of fairness, justice, and protection of rights, while also offering an enforceable mechanism for resolving disputes.


• Demonstrate Governance Capacity: 
These groups must provide a blueprint for governance that extends beyond merely political rhetoric. A credible template must address economic development, social welfare, human rights, and law and order in Kashmir. Without a demonstrated ability to govern effectively, their proposals will remain abstract and unconvincing.

• Engage International Stakeholders: 
The solution to the Kashmir issue will require the buy-in of multiple international actors, including India, Pakistan, and UN member states. The nationalist groups must prove that they have the diplomatic and political acumen to engage with these countries and gain their trust. This requires presenting a solution that is not only seen as fair and just but also pragmatic and achievable within the existing geopolitical realities.

5. The Need for a Template for the Future

A critical flaw in the nationalist groups' current approach is their failure to offer a clear and actionable vision for Kashmir’s future. Moving beyond rhetoric and historical grievances, these groups must present a comprehensive template that outlines how they plan to build a sustainable and peaceful future for Kashmir. This includes establishing political institutions, promoting economic development, and ensuring the protection of human rights for all people in the region.

Any solution that seeks to challenge the UN framework must be able to engage both regional and global powers, offering a credible path forward that reflects the desires of the Kashmiri people while ensuring peace and stability in the broader South Asian context.

Conclusion: A Coherent, Viable Alternative

In conclusion, the nationalist groups in Azad Kashmir face a significant challenge: they must move beyond their internal divisions and present a unified, credible vision for Kashmir’s future. The UN framework provides a neutral, internationally recognized mechanism for resolving the dispute, based on the principles of self-determination and inclusivity. For any alternative to be taken seriously, it must provide a clear political framework, establish credible symbols of authority, and engage India, Pakistan, and the international community in a meaningful dialogue.

Until these nationalist groups can demonstrate the ability to build such a framework—one that respects dissent, ensures inclusivity, and has the capacity to govern effectively—the UN process remains the most viable and legitimate pathway to resolving the Kashmir issue.

An example of inherent weaknesses in our approach to documentation activism (ref yesterday's live video):

Many of our co-citizens and especially those who were affiliated with the Joint Awami Action Committee #JAAC , were arrested from their homes in the early hours of 09 May 2024, whereby local #AJK police marshalled by #Pakistan 's clandestine agencies broke into many people's houses and physically tortured many an activist. In the following days and weeks many other activists experienced human rights violations too. 

I asked some of those responsible in JAAC to send me brief video testaments of each aggrieved co-citizen, so that I could translate then into English, to document and create a comprehensive report. 

Which I would then send to every prominent human rights organisation in the world and all those countries that have stakes in Pakistan. 

This would have added strength to #RightsMovementAJK and narrowed the possibility of Pakistan conducting such operations here ever again. 

However, not a single such video statement has been sent to me.

Daily Diary (DD) - Day 291 of 2021

Have spent some time at home today - in between travelling to various events in the region from Bhimber to Kotli - to try and update the public on activity generated over the past few days. Indeed, there have been literally thousands of events and issues that I have covered or participated in, over the last decade or so which despite being logged comprehensively have yet to be published online. 

I am trying to change that.

I wasn't able to accompany the 'Watan Bachao March' of JKLF - R on their journey from Chakswari to Dadyaal on account of family commitments, including taking my mother to the family home of Rasheed Khan s/o Sheikh Abdul Aziz; who had settled in Canada some years ago but tragically succumbed to cancer at a relatively young age. His body arrived today and many people from Kotli and afar descended to his funeral. He was a very talented citizen who had a good grasp of our 'National Question and will be sorely missed.

Two legal stalwarts - both originating from Jammu Kashmir & Allied - one a 74 year old Kashmiri Pandit who retired as Chief Justice of the Indian Supreme Court while the other was a 87 year old former Chief Justice of the High Court in AJK.

Two observations:

In general, I agreed with most of what Justice Abdul Majeed Malik had to say as opposed to what Justice Markandey Katju had to say, except on 2 points.

1) The British were foremost responsible for the partition of India based on religious identity. Both the Muslim League and Congress were complicit in their own ways.

2) Azaadi or freedom cannot and should not be merely parroted for attention. There must a method, a narrative and a practical plan for governance that will provide our detractors a rationale for accepting our stance.

Finally, it may be worthwhile to note that we have already reached our eighth week of a regular weekly programme (Every Sunday at 9pm AJK time) in pursuit of defining our internal narrative in AJK:

Daily Diary (DD) - Day 83 of 2020

An impending lockdown for a month in AJK has at least reminded us that we are - after all - part of a rapidly shrinking world.

We may not have access to most of the positive aspects of globalisation but we are deeply mired in its negative outfall.

Over the past few weeks I have tried my best to avoid the subject of Corona or it's technical term Covid-19, hoping that it wouldn't become the pandemic that it has.

Once we get over this, I look forward to returning to the subject of globalisation and its impact on this territory that has been hidden behind the heavy curtains of Indian and Pakistani nationalism, by the outgoing British empire in and since 1947.

This is of course an indication of how precious Sharda is to our Hindu brethren across the LOC but it is also a confirmation of why it shouldn't become the symbol of an ownership tussle between India and Pakistan:





The solution? A genuine internal J & K political process!

Let me tell you a story of my past..
I am the aboriginal of the country called
Sharda Desh, which was invaded by
A Virus called Kashap Rishi back in time.

Before his invasion we were happy
In the Satisar Lake and hardly ever
had to come to land for our BREATH

In order to know the secrets of our
lives & pious living, he bllasted the
Shiv Mountain at Varamul & drained
The SATISAR Lake. 

The broken Shiv rock which was the same as Shiv Mountain was, under this rapid flow Of waters, got lost in it and emerged only  At Kanyakumari in TamilDeshyam during the Times when Rama was looking for his lost wife. 

This shivlingam is still worshipped & is very energetic stone which has brought prosperity Happiness and contented way of life to this part of the world

As it is said that if you remove whole from the whole, what is left over is also a whole. 
Same thing was demonstrated to him by the Presiding diety of Sharda Deshyam,  which is 
" If you add a whole to a whole, what emerges out is also a whole".

Now back to story... 
... .....So since he could not found out as to how do humans who looked like himself and had same 108 / 112 body parts, could live under water where as he could not despite he had tried every thing being a seer himself & having the good hand of GODs over his head.

This helplessness fired his Intellact, rage burnt his compassion and thus a saint transformed himself into a devil & then did what he did which was recorded by SUN & Moon, the Time keepers themselves. 

Once Satisar was empty, the land emerged under was claimed by him and his progeny.. And thus he renamed the Sharda Deshyam as Kashyapvaaar. 

It was force full occupation of the land and it's mountains vales and of its natural habitation.

He converted our forefathers into his 
beliefs & started teaching Yoga 
and Pranayam.. 

He established the Manus codes of social conduct & established a new socho poltical religious arrangement which layer on were taken our by the mellecha from swat & Arabia.

Some of us who were haanze  & used to live in our wooden boats Called DoooGa, moved to Matisar Lake for survival.

On one side of which was Ishbar and on other side Sharika... 
Kashap Rishi spend 4 Yugas in yoga &  in his dyaan and meditation but could not couldn't broke secret door of life. 

Once he departed from our Sharda desh
We the aboriginals expressed joy by renaming the Matisar Lake as DAL LAKE, the name which is intact even today.. 

During his stay in our country  we secretly developed a new language called Koshur and gave it his name to buy peace. 

While we were developing the new language under his mentorship we had only 
Trika as our asset.
 DAL, meaning madness (go insane)
and the one who is in search of God conciousness is labeled or called as DALMUT.. 
Meaning a mad man who is in pursuit of some thing which breaks the law of life & living & places himself in the state of not knowing.

This state has been referred by the de illusioned prince Sidharth as void or nothingness.

It was this word DAL.. 
meaning GO & Get Lost and Remain lost for ever was seized in time by the aboriginals by renaming their life sustainer  food provider & lotus breeder as DAL Lake.. 

So now I am writing to you & informing you that 
Sir being the foreign minster of a very rich civilization, you too do not DAL at any cost come what may . But come to DAL in Kashmir & Invite me as well (of course u have to pay for my travels since I stay at Chennai), because I am being considered as DALMU & am the only surviving custodian of this secret Knowledge of survival in any circumtances including the knower of not knowing.

So Sir, my this letter be taken as very seriously and action is solicited and you would be buying the  wellbeing of your people in return while we would be  sipping kashmiri tea, in the DooGe. overlooking the hill of Shankara and  Sharika on the Hills of Padhuman...

      I know that my letter even if reaches you yet you won't act on this since  you are so convinced about your enemy and your fear of his which infact has  fortified your entire thought process  & as such you won't grasp any word of my letter probably will reject it summarily since sentences you are reading here are from the Desh of Sharda,  the abode of Five Goddess of Knowledge which carry no meaning at all...

The universal energy that resides in the place called  Shakti in my language ane have five manifestations taking care of the five directions are.

1. The Sharda Deshyam. (Shiva consciousness.. Called Matter) 
2.The Sharda Devi. (consciousness Called energy ). 
3.The Sharika (Awareness Pran, called Soul) 
4.The Ragni (Joyfullness, called wellbeing) 
5. The Zeashta (procrastination, called rest). 

Now see all the above shall appear noise to you & why not since what is original presound Bhairva is noise pure noise & you have no way means to grab any meaning from the sentences written here even if the letter is written in english language which is known to you and your have achieved mastery in this language as well.

I can understand that after reading the above para you would be lost and it is likely so , since u have no means to know what all is there & why people live and behave they do they way they do..
I do not want you to get bored or  trapped in the nonsense I penned here rather you should seek resolution and  answers for a 
the greater question which is .. 

        What for USA is spending all their Petro dollars,Nuclear bombs all the medical & engineering advances research that include  to interpret a single beat from distant galaxies,

Just to illustrate one example (in Azaadi Chowk, Muzaffarabad) of many in AJK over the past few days, whereby the Pakistani narrative has been overtaken by the local internal narrative of AJK in protests against the unilateral amendment of Article 370 by the BJP in India:

I always felt that the ghost of Maqbool Bhat will always haunt both India and Pakistan until they vacate the territory of Jammu & Kashmir. This article (written on February the 11th 2014) by a budding writer/economist from Rawalakot is a timely reminder of how India's preemptive unilateral action has not only embarrassed Donald Trump but more so the State of Pakistan who's inherent contradictions over the 'freedom struggle' of Kashmir have exposed it to the hilt:

Daily Diary (DD) - Day 158 of 2019

3 Layers and Multiple Sub-layers in each Layer of the Jammu & Kashmir Dispute:


There appear to be 3 layers of power (with accompanying narrative/s) relevant to understanding the unresolved dispute of Jammu & Kashmir. Both modus vivendi and modus operandi are in use in different measure and combination, within and between each layer.

1) United Kingdom (Great Britain/Empire)

Sub-layers would include the international community with a mixture of combining and separating almost everything beyond India & Pakistan. That would be Western/global institutions viz. UN, IMF, World Bank, the wider region including China, Central Asia, Russia and the Muslim World.

2) India & Pakistan

Sub-layers would include all narratives; be they hawks or doves, or left and right of the political spectrum in both countries, They would also include both those who don't want the world to interfere in the domestic affairs of either State and those that do, or don't mind.

3) Jammu & Kashmir (J & K)

This would include the whole princely State of c. 86,000 square miles. Of course the divided population is also going to comprise of a diverse range of sub-layers. Some pulling towards the Indian narrative, some towards the Pakistani narrative, some espousing other narratives linked to other external entities and then a perhaps even more diverse group representing an internal narrative of some kind.

Now, in the power equation the numbers 1 to 3 are in the right sequence, in more respects than one. During the colonial era, there were 2 tiers or layers (in our contextual parlance): that of the British Crown and its subjects. Thus, there is history, geopolitics, economy, technology, research and a host of other factors that cement the sequence in place.   

I realise that not all readers will be predisposed to accepting such a sequence. However, most people who follow the status of Jammu & Kashmir's geopolitical ambiguity will at least concede that any conscientious inhabitant of this territory - who may be deprived of all his or her fundamental rights at will - may reasonably make such an assessment. Further, the reader should also take into account the prevailing status-quo since the ceremonial transfer of British colonial power to the dominions of India and Pakistan in 1947. The gradual dwindling of internal political agency - be it the autocratic ruler or his subjects - including those acting as political representatives of the people - should also be noted.

If we assume the above as a 3-layered geopolitical power hierarchy, the challenges facing the civil rights activist in any part of J & K - to achieve public policy objectives in favour of the internal narrative/s - are as necessary to meet in 2019 as they have proved elusive since 1947.

Our shared humanity requires us to accept everything we expect for ourselves as a fundamental right to be available or exercised by all other homo sapiens. There is a deeper level of thinking needed beyond 'national' limitations to meet the seemingly ever more complex needs of tomorrow. 

Can the internal narrative of J & K triumph for the sake of humanity?

How does it navigate through the 3 layers of geopolitical hierarchy?

How does it interact with the multiple sub-layers within and between other layers?

All real and tough questions that need understanding. 

I need internal assistance.

Indian and Pakistani armed forces can enjoy a good time together, even if it may be a few thousand miles away in Chebarkul, Russia. It is not as unthinkable as the residents on either side of Jammu Kashmir & Allied's manufactured border are led to believe, or for that matter even the world is led to believe. 

Contingents of Pakistani and Indian armies were participating in a joint multinational exercise organised under the umbrella of The Shanghai Cooperation Organisation (SCO), or Shanghai Pact, in Russia. 

The exercises began on August the 24th 2018 and concluded on August the 30th 2018.

14) No piped gas (except in parts of Mirpur city)

Daily Diary (DD) - Day 86 of 2019

The Law of Averages:

We could write a treatise on this phrase but even without academic rigour or reference, there is a lot that we can discuss through the prism of every-day life.

Let's remain focussed on society in AJK.

The law of averages throughout the modern world in the context of mono narratives - in any given society - would suggest that they are not sustainable in the long run.

As we're talking about societies in nation-States (particularly contested ones) and since the Europeans are the architects of this structure, we have licence to use examples from there or in that vicinity.

Hitler's Germany, Mussolini's Italy and Stalin's Russia employed a mono narrative. The Pakistanis have employed a mono narrative in AJK and Gilgit Baltistan (we will usually adopt GB for short in a similar manner to AJK for Azad Jammu & Kashmir).

The law of averages may dictate an inevitable failure.

There are 2 almost distinct narratives that exist in AJK and GB. I say almost because no prominent narrative can be monolithic. One is an internal narrative and the other is a Pakistani narrative.

Since Pakistan controls these 2 territories without legal reference, as being a respondent party of a non-enforceable forum (ref. UN chapter 6) doesn't provide a country de jure status. This dilemma compels Pakistan to base its control on certain assumptions that rely on the majority opinion of the internal inhabitants - the primary stakeholders in this conflict - to unconditionally support their stance. Hence it (Pakistan) considers it - as a matter of survival - to strictly control the public narrative here.

Control the narrative and you control the territory. De facto. As simple as a white flag.

Not recognising (or even acknowledging) the presence of other narratives is suicidal for a nation State.

What if the United Kingdom didn't recognise that a Scottish aspiration for independence exists? What if England and Wales did not recognise that there are citizens who don't want a Brexit? What if the Catholics of Ireland didn't acknowledge that their Protestant compatriots had a different view on national politics?

Closer to the Muslim world, what if Turkey didn't recognise that there are a significant amount of Turks who prefer to be part of a secular Europe rather than a rejuvenated Ottoman Empire?

All aspects of governance, public policy and conflict resolution (an oft cited term in the context of Jammu & Kashmir) follow the cue provided by the State (assuming charge of AJK and GB), based on the contrived perception that an all-encompassing dominant narrative exists, that unquestionably but conveniently favours the State's accession to Pakistan.

Even if we assume that Pakistan had entered AJK and GB in 1947 peacefully, by measuring the needs and opinions of the inhabitants beforehand and then legally sanctioned its presence, they would still have no right to impose a mono-narrative on these parts of the erstwhile princely State of Jammu & Kashmir.

Some would argue that Pakistan imposes its narrative in AJK and GB in the manner that it does, precisely because it could not and cannot sway majority opinion in its favour.

The average person who lives in this territory recognises that these 2 distinguishable narratives co-exist in real life. Everyday transactions between individuals in society reflect that average reality. They manage the 'occupation' (of course not everybody regards Pakistan as an occupier), hence society continues to function regardless. However, because it is militarised through external interference (primarily to protect that State's narrative), the territory has no internal control over governance and public policy and is compelled to abide by that Pakistani narrative, through social, economic, judicial and even at times extra-judicial means.

The system cannot grow organically - on its own resources - both human and natural. A mono narrative is by definition autocratic, anti-life, suppressive of human instinct and simply unsustainable.

There is little conviction in toppling one autocracy (the Dogra Empire) to become part of another autocracy. A Hindu autocracy, a Muslim autocracy or a Christian autocracy is by all means an autocracy. However, this current autocracy is hell-bent on extraction and expatriation. Dogra rule (1820s to 1947) can be rightly accused of many crimes but extraction and expatriation of resources is not one of them.

The citizen of such a territory: be they day labourers, judges, politicians, academics or anyone else will remain camouflaged to survive and succeed.

If any internal entity or body peacefully challenges this imposed mono-narrative, they will immediately be accused of bias, working for the enemies of Pakistan and/or tabooed as a perfect candidate for being put in a mental asylum, or at least deserving of some form of character assassination.

In a system of governance that pivots its existence on bias, it is a cruel irony that bias is the first allegation that is provoked in response to an alternative narrative. It is quite possible that the most instrumental enemies of Pakistan are a product of the internal contradictions of that society. That could be the case in AJK and GB too. Introspection can deliver answers in each case I suspect. It is also possible that the mental asylum candidate could be a genuine candidate for the Nobel peace prize.

In principle, there cannot be a difference between the nationalism of Balawaristan, Bengali nationalism, Indian nationalism, the nationalism(s) of Jammu & Kashmir or even Pakistani nationalism.

Each philosophically justify their 21st century nationalism according to the structure of Westphalian sovereignty introduced in the 17th century.

In an Islamic context, one nationalism cannot be halaal while another is haraam.

One nationalism cannot be legitimate at the cost of the other and that is the basic flaw of the Indian Independence Act, drafted and hurriedly but partially implemented by the soon-to-depart British Raj in 1947.

Let's return to the imposition of a mono-narrative in AJK and GB. With the internal inhabitant still struggling to cover the journey from a subject of the Dogra Empire pre 1947 to an aspiring citizen of AJK or GB, it has been established that our proclivity to resolve our 'national question' has been stunted in a targeted manner, where fear is a lifelong companion for most inhabitants.

It could be helpful to remember that the law of averages also dictates that many rainy days will inevitably be followed by a sunny day.

When I instinctively decided to review the Pakistani female writer Anam Zakaria's compelling book on AJK 'Between the Great Divide: A Journey into Pakistan-Administered Kashmir', I felt it almost equally compelling to write the above as a preliminary review, which I may as well title as 'The Law of Averages'.
