Daily Diary (DD) - Day 219 of 2022

I have slipped once again, though by just a few minutes. The good news is that I am slipping less often than not.

Tonight's live Twitter space conducted by JKTV was packed with various MLAs (Members of the Legislative Assembly) including Choudhary Yasin, Sardar Attique, Hasan Ibrahim, Shah Ghulam Qadir and Raja Farooq Haider. It also had Dr Nazir Gilani to provide the much needed - yet hitherto - absent legal compass for both politicians and the listening public alike: 

Of course, I did make my contribution too albeit about 2 hours and 54 minutes into the programme. For very compelling reasons I thought it opportune to bring Raja Farooq Haider off his 'high horse' and amongst other objections to his conversation I described him as 'guilty' and 'undemocratic'. Previous to my input he had answered some questions put by the public but considered it prudent to 'flee the scene' during my conversation.

From 1947 to 2022 India avoided collecting public opinion of the people of JKA as they knew they would lose.

From 1947 to 2022 Pakistan avoided collecting public opinion of the people of JKA as they (foolishly) insisted In advance that the people here provide an oath of allegiance.

From 2011 to 2016 an inheritor of this very territory diligently collected public opinion in AJK and an overwhelming majority exposed the bilateral collaboration of both countries.

Now that inheritor has been waiting for 36 days at Martyr's Square Kotli , anticipating the remaining inheritors.

As much as I try and avoid him, he seems to cross my path, albeit virtually:


Earlier in the day, he (Raja Farooq Haider x. PM of AJK) had made some bold noises about the State of JKA. However, he usually follows that up with a meek apology to the masters who control him in Pakistan. In my opinion, he's more of a liability than an asset:


To paraphrase what he said:

India and Pakistan cannot divide this territory between themselves. The land of JKA is not bait ul maal (war booty) or khalsa sarkar (crown land). He also reiterated his demand that AJK be recognised as the genuine successor state to the Dogra State of JKA. Gilgit Baltistan should be given a AJK like set-up and have confederation-type terms with AJK.  

Haider also reminded the audience that he had categorically informed the senior leadership of his party (PML-N viz. Pakistan Muslim League - Nawaz) on the 25th of December 2020 that if they - the party - took any steps to permanently divide the territory of JKA between India and Pakistan, he would be the first to revolt against them.

JKA is not a territorial issue between geographic neighbours but a people's issue, which only the people can represent themselves, to the outside world, he repeated once more to an audience outside Islamabad press club.

Bearing in mind what he says disparagingly about 'bait ul maal' (this term also applies to evacuee property) and remembering what Malik Waseem & family have gone through to remain caretakers of Ratan Singh and Sardar Singh's land in Naluchi Muzaffarabad, it is obvious what he - Raja Farooq Haider - and others in the AJK government and administration think about 'bait ul maal'. A 'free for all' is what he is implying.

Daily Diary (DD) - Day 360 of 2021


1412hrs:

A lot of commotion happening on JKA. That's Jammu Kashmir & Allied. A nomenclature I'm using to make simple sense of c. 85,000 square miles of territory, geographically situated between (six) of the largest collection of mountain ranges in the world and in the vicinity of almost half the world's population. Among other strategic factors, it is the most contested freshwater source of the world too. 

Yesterday evening a notable personality of our territory, asked me for a note on happenings over the past few days, in relation to JKNSF Azad's emphatically successful convention on the 24th and 25th of December in Kotli.

He wanted to send it to some foreign diplomats.

There's a lot of untoward happening in the United Kingdom too. We are investigating obstruction and illegal surveillance of the internal narrative in AJK there.

Here's the note:


















Growing tension emerged between pro Pakistani influences and pro freedom voices over the past few days in AJK. This was in the wake of 27 year old chairman of Pashtun Tahaffuz Movement (PTM) Manzoor Pashteen's invitation to attend Jammu Kashmir National Students Federation's (JKNSF Azad) convention in Kotli on the 24th and 25th of December 2021.

Despite being a peaceful movement of Pashtuns seeking redressal of grave human rights violations on their people by the military organ of the Pakistani State, PTM's genuine grievances rather than being heard have led to them being proscribed and targeted for raising their voice. Such a movement's chairman being invited into AJK by a decades old students organisation in this territory - known for its 'resistance of occupation' politics - created panic in Pakistan's establishment circles.

The latter reacted by issuing a notification to ban Manzoor Pashteen's entry into AJK on the 22nd of December. They also underwent a propaganda drive to counter NSF's (short for JKNSF and used hereon) convention. A previously obscure organisation 'Tehreek e Jawanaan Kashmir' (referred to as TJK hereon) led by Irfan Ashraf of Rawalakot led this propaganda drive in favour of the Pakistani State, by announcing that they would celebrate M. A. Jinnah's birthday in Kotli on the 25th; as a show of power to drown out nationalistic influences in the territory. Meanwhile, the Pakistani State also tried to prevent the NSF convention from going ahead as announced.



What transpired on the 24th and 25th of December is that the NSF convention went ahead as scheduled in Kotli. Many other pro freedom voices and parties announced their solidarity with the NSF and condemned the Pakistani State's attempts to muzzle internal voices here once again. Even advising the NSF to defy these obstructions.

Irfan Ashraf known to work very closely with Pakistan's intelligence agencies - which almost won him a legislative seat at the recently concluded elections here - couldn't muster more than 20 people for TJK's birthday celebration of Pakistan's founder on Christmas Day. This is despite the heavy propaganda campaign leading up to this event. A day before in Kotli (on the 24th) they had tried hard to persuade the public of Kotli - by loudspeaker announcements throughout the city - to participate at this event. It is clear from photos, videos and local knowledge that hardly any local participated. Those who did were either from Rawalakot or were Pakistani citizens.

Whereas JKNSF Azad engaged a few hundred people at both their convention on the 24th and their public gathering on the 25th, as photos and videos will indicate. They were able to gain sympathy and credibility at home and abroad while those sponsored by the Pakistani State could hardly gain any traction in Kotli at all.

There was heavy police presence throughout Kotli over these couple of days, as anything was possible. The 'authorities' did jam communications through part of the day on the 25th, which prevented Manzoor Pashteen from addressing NSF's convention via electronic communication.


It has been noticed particular in the last couple of years - post August 2019 - that whatever the Pakistani State does to counter Jammu Kashmir & Allied's internal narrative - tends to backfire on them - leaving them humiliated and exposed in the eyes of local public opinion as well as among our diaspora. Countless examples can be referred to in this respect.

Meanwhile, on this very day an interview of former prime minister of AJK Raja Farooq Haider was conducted by JK News Urdu in Smaahni:


Here are some salient points that he mentioned during his interview:

AJK is not recognised anywhere in the world and Pakistan has never taken this point seriously. The latter is adamant on representing us.

There is a concerted effort to dilute the 'Kashmir Issue' and permanently divide the territory of Jammu & Kashmir between India and Pakistan. Pakistan's attempts to merge Gilgit Baltistan into its federation is a step in that direction.

The recently concluded 'Russell Tribunal' in Sarajevo (Bosnia) has nothing to do with the Pakistani government. It was something instigated by our diaspora. Pakistan's role is effectively non-existent.

Demographic change is taking place on both sides of the Line of Control and Pakistan was first in conducting such measures (in GB).

Raja Farooq Haider reiterates the point that until the people of this territory are not given the opportunity to represent themselves, Kashmir will continue to be perceived as a land dispute between India and Pakistan. In such a scenario, the world will always give precedence to the rising economy of India rather than the sinking economy of Pakistan. Thus, we have no face value, he contends.

The State of Jammu & Kashmir is a multi religious society, not a fundamentalist Muslim entity.

His concluding message to all citizens (young and old) of Jammu Kashmir (& Allied) as it stood on the 14th of August 1947 is to do whatever is possible to save this State, if you want to continue your existence.

He recognised that our plight is because we are surrounded by large nuclear powers and that we need to instigate democratic institutions throughout the developed world. He also recognised that there is barely any democracy in the Muslim World. Raja Farooq Haider considered social media to be a powerful tool and urged our people - local and in the diaspora - to persistently highlight our plight.

Daily Diary (DD) - Day 199 of 2020

So it has become apparent that the AJK Assembly has plucked up the courage to reject Pakistan's proposal (read order) for the 14th Amendment which would have reversed most of the gains achieved in the 13th Amendment. Everything is still under a cloud which is true to form of the Pakistani State, which has relied on obfuscation as its most potent weapon since 1947.

One needs to go through the proposal - which cannot be guaranteed to be the actual version - not least because it gives an impression that it has been proposed by the AJK Assembly itself when in fact it came from the direction of Pakistan's federation, apparently on the 20th of June this year. Here's a copy of what is publicly available:

The rejection of the above proposal (or direction) by the Pakistani State to amend the constitutional framework (which is in fact not constitutional as it has no local input and was imposed in 1974) operating in AJK was rejected unanimously by the AJK Assembly. Here's a press release in Urdu to that effect. It was made public yesterday but has a time stamp of the day before yesterday:


As it is in Urdu, public interest would dictate that I translate it into English for the benefit of our English speaking public as well as the world at large.

Thus:


(The) Free Government of the State of Jammu & Kashmir

(Press Release)

An extraordinary convention of the Azad Jammu & Kashmir (AJK) cabinet took place on the 15th of July 2020, presided over by Esquire Prime Minister - (of the) Free Government of the State of Jammu & Kashmir - in the cabinet committee room (Prime Minister's Secretariat) Muzaffarabad. Also present in the meeting were (representatives of) the Department of Law and the Department of Kashmir Affairs. The documentation received from the Government of Pakistan, in reference to the (proposed) constitutional amendment on the 22nd of June, was discussed and reflected on at length. The cabinet made the following decisions on the subject of the proposed documentation:

i) 
The cabinet has not completely agreed with the constitutional amendment documentation.

ii) 
It is the collectively agreed opinion of the cabinet that the State of Jammu and Kashmir has an ideological relationship with the motherland of Pakistan, which is a manifestation of the undying aspirations of the Kashmiri people. This is not merely the ownership of an individual, party or government but in fact the collective ownership of the inhabitants of the State (of Jammu & Kashmir), on both sides (of the divide). This bond is completely in accord with the vision of the honourable father of the nation Muhammad Ali Jinnah, the founder of Pakistan.

iii) 
The cabinet has further expressed that on the basis of the action taken on the 5th of August 2019 by the Indian government; the accepted international status of the Kashmir issue, the will of the State's people and their fundamental rights have been violated. In order to achieve its vulgar aims, the Indian government has taken this step in order to change the demography (of the territory under their control), which is in total contradiction of the United Nations Security Council resolutions. In this context, for the purpose of translating the aspirations of the inhabitants of the State of Jammu & Kashmir - on either side (of the divide) - it is requested that steps be taken via mutual consultation to further empower the government of Azad Kashmir.

iv) 
The cabinet has also expressed the opinion that constitutional matters via mutual consultation can only be decided in accordance with public aspirations and the intent described in article 257 of the Pakistani constitution. For this, mutual consultation is needed at the highest level (of Inter-State relations.

v)
The cabinet through collective agreement has expressed their full and complete satisfaction in the leadership of Esquire Raja Muhammad Farooq Haider Khan, the prime minister of the free government of the State of Jammu & Kashmir.

Daily Diary (DD) - Day 126 of 2020

A 2:41 minute audio message in Urdu was sent to the prime minister of AJK today.




English translation followed by transcription in Urdu:

Greetings Respected Farooq Sahaab. The narrative (which we are referring to) is one that your 49 members of the (AJK) Assembly cannot espouse, due to certain compulsions or enticement that they've drawn themselves into and that has been the story - on aggregate - for the past 73 years.

We affirm that the transitional process - through the means by which - the system changed here in 1947, did not emanate through due process and whatever changes have emerged were conducted by the representatives of the British Crown. There was a proviso* that the people would be consulted (referred to) in the aftermath of whatever commotion took place in October 1947. Indeed, in that very letter in response to (Maharaja Hari Singh's appeal for military assistance) written by the then Governor General of India Lord Mountbatten.

This should also be kept in mind that the system of governance in India was (effectively) administered by the British up to 1950 while in Pakistan they remained till 1956. Thus, all developments occurred under British supervision. The Indian Independence Act and all that happened of consequence were under circumstances whereby the whole system of governance and administration viz. the economy, defence etc. remained under their control. 

So Indian Governor General Mountbatten in response to the Maharaja attached a proviso that when peace is restored then we will refer to the people (to determine their future). This is our first point of reference.

We don't need to leap forward to the United Nations. This issue was created by the British Empire and the solution leaves some parts of the key in London whilst the remaining parts are here, on the ground.

Thus, if we want a solution then that requires an initiative here (on the ground). In that manner, we will appear forthright in our approach to the world and hence be effective. What would emerge as our narrative to the world requires an internal process.

I think these words should suffice. This will be our second (Assembly) session. Our inaugural session was conducted on Sunday the 9th of February outside the Assembly Secretariat in Muzaffarabad. I'll send you the video link here...thank you very much.

Daily Diary (DD) - Day 348 of 2019

I have been burning the midnight oil to get through a lot of things on our public agenda.

This was just one of them:



I always knew this video would have to be re-visited from time to time.

Here are some points that I have extracted from his speech and translated them for added clarity:

n.b. Time (in video) is followed by extracts of his speech.

13:06 - Pakistan's foreign policy is not in sync with the needs of the Kashmiri people.

14:22 - According to a survey in the (Kashmir) Valley, sympathy for Pakistan was at 6%.

14:32 - At night on the internet I see people mobilising for an independent Kashmir.

14: 45 - How governments are made and broken here - (the absence of democracy) - that Kashmir (Valley) has been robbed and we don't want to become someone else's colony. Or some other country's citizen(s).

15:19 - An innocent woman cannot live between 3 gangsters (aik sharif zaadi 3 goondo ke darmiyan nahi reh sakti!) This is difficult, it cannot happen. We don't know who controls the (Pakistani) foreign ministry.

18:14 - This constitutional set-up is not capable of fulfilling the aspirations of the people. This is not possible.

19:39 - The role of Chief Election Commissioner is also used to wring our necks.

23:35 - Pakistani PM Gilani whispered in my (Raja Farooq Haider's) ear that I will get Kashmir for you! 

24:00 - We (AJK) have no voice. We don't exist.

24:36 - Amend Article 257 of Pakistani Constitution to bring it up to date. Add another article and take us back to the acceptance position (of that standstill agreement) and let us do our own thing! Its as simple as that!

24: 57 - (While narrating a conversation with Pakistani PM Gilani) Ghulam Sadiq and I may be talking to you nicely but who (of us) you meet in future may not be so pleasant, when talking to you.

25: 32 - When the money is mine then taxation is my job, I have to spend it (and do budgeting). Why should Manzoor Watoo (then Minister for Kashmir Affairs) give clearance?

To ask the Secretary of State for Foreign and Commonwealth Affairs, what assessment he has made of the adequacy of the implementation of UN resolutions to uphold the human rights of the Kashmiri people.

We recognise that there are human rights concerns in both India-administered Kashmir and Pakistan-administered Kashmir. Any allegation of human rights abuse is deeply concerning and must be investigated thoroughly, promptly, transparently and independently. We encourage all states to uphold their international human rights obligations and to ensure domestic laws are in line with international standards.

The shadow minister asked an important leading question which was totally ignored. I would clarify that the UN resolutions cited in the question are not just inadequate but impractical in 2019, as they rely on successful Indo-Pak bilateralism, just like the UK government does. After all, it was the then UK Government (in 1947) that facilitated the UN process for both India and Pakistan, if only to shift attention away from itself for facilitating the entry of Indian and Pakistani troops into Jammu & Kashmir. They both (the UK and the UN) deprive the people of Jammu & Kashmir of agency in their own affairs.

Daily Diary (DD) - Day 261 of 2019

2221hrs:

The Pakistani State narrative tried to confront the internal narrative in Bhimber city today. The Pakistani State's illegal agency operatives tried their best to prevent activists of the Jammu Kashmir People's National Alliance (JKPNA) from distributing pamphlets to the public of Bhimber. However, they were thwarted by a firm civil society response and outrage from other parts of AJK and its diaspora. As explained hitherto, the AJK police are also a part of this society and thus share similar sentiments with the public. This sentiment can be encapsulated in the following messages:








Obviously this second image will have to be translated. Thus:

We vociferously condemn the illegality of the cowardly administration of Bhimber, which - without reason - kept Kashmiris under duress and stopped the public from propagating the truth.

It should be remembered that the word 'administration' is a euphemism for Pakistan's agencies which are now desperately trying to protect their country's narrative in AJK but with decreasing effect.

However, we do not think this issue can be resolved by India and Pakistan with an international mediator, even if it included Kashmiri representatives. That is a very unlikely scenario and even if it were to proceed thus, there would be little that the exclusive inheritors of this territory could claim. 


As someone who lives and thrives in a functioning democracy why do you not make suggestions for J & K that you would want for yourself if - God Forbid - the UK were to be occupied by France and Germany? 


Please support an internal political process in J & K without external interference. The world should accept a solution democratically created within J & K rather than open it further to regional and international intrigue.
