Daily Diary (DD) - Day 194 of 2020

0114hrs:

It was only the day before yesterday that I was discussing the rising amount of threats from the 'not so deep' Pakistani State to a number of our citizens; from established politicians to writers and activists. The following post is a statement made yesterday by a very seasoned and upright journalist in AJK's capital Muzaffarabad:


As I've mentioned in a comment on this post, I have often read his clearly worded articles in Urdu media and have most often felt the need in public interest to translate his writing into English. I've failed to do so thus far but now that his life is clearly on the line, this could literally be a matter of life or death if I don't:

Life is endearing no doubt......but?

"We will abduct you!"....."We will see to you"...."We will make you serve as a lesson (for others)"..."Confine yourself to your shoe size"....

What kind of mindset is this?

All right. It is understood that those equipped with power and resources can do whatever they want but for a limited amount of time. I am unarmed. My only weapon is my pen. Hitherto, thousands have been abducted and what would happen if I am to be included in this list? One has to die ultimately, whether today or tomorrow (now or in the future)......so be it if it is today.....

However, it should be remembered that I will not beg to stay alive. My case and my ideology is absolutely straight and clear. I talk of humans, I talk of their rights, I talk of their self determination and I talk of their genuine freedom.....

I have never been an opponent of the public of Pakistan. I have never talked against the public of Pakistan. Yes, I speak of my rights. I am of the view that my people deserve total freedom and I am so totally certain of my ideology that it is akin to the belief in all of us that the sun will rise every day.

This territory which is referred to as Azad Kashmir has transformed into an open pasture; there is an environment of coercion, every individual is a prisoner of their own circle (of thought) and stepping out of (that circle) is treason. The people's right to governance is now only in name (empty posture). Steps in contrast with the public mandate are being taken. Operating beyond one's jurisdiction has become tradition. 

The recording of telephonic conversations of our womenfolk is tantamount to playing with our self-respect. Can any such activity be considered as acceptable?

(What about) the act of bringing untrustworthy and corrupt politicians into power in Azad Kashmir for nefarious purposes and then teaching them lessons when they occasionally don't oblige? Making governments, breaking them, changing the prime minister, making self fulfilling agreements and (constitutional) amendments; What have all these issues to do with peace and integrity?

(it should be noted that the Pakistani clandestine agencies have a habit of cornering genuine criticism by turning the tables and citing their country's integrity to be on the line, when such criticism emerges. In other words, anybody who identifies corruption, malpractice or unaccountable behaviour in general by employees of the Pakistani State are victimised by the latter as inviting instability and destruction of their State)

These questions will arise....and I will continue raising these questions. The ideological front is another subject but we can never give permission to anybody to destroy our social fabric (environment). Be it the prime minister Farooq Haider, any other politician or some powerful department. The mantra of politics politics, government government, control control may well be chanted (and played). By all means be corrupt......loot (resources as much as you can).....I will write against such activities according to my capacity and as a journalist identify such (within my means).

However, when (the backlash) reaches our doorstep then life no longer holds any meaning....Any such action - whether individual or collective - cannot be tolerated under any circumstances.

As for the threats against me...I'm in no mood to fight and I have no inclination to engage in any such adventure. In all likelihood more than anything else, I may use the option of protesting underneath a banner along with my friends or those of my friends residing in Europe may stage sit-in protests outside (relevant) consulates/embassies etc. 

I would leave those who hold the mandate of threatening others to their own devices. Time will decide what ensues.

I am grateful to all those friends in the USA, Europe, Pakistan, Azad Kashmir and in particular my journalist friends for the manner in which they've shown solidarity with me...my friends in Europe have written to human rights organisations against this coercion and have furthermore pledged all possible support.

Daily Diary (DD) - Day 258 of 2019

2101hrs:

We are getting increasingly concerned at the witch-hunt being conducted by the AJK police in Muzaffarabad of public activists, under the watchful eye and mentoring of Pakistan's roving clandestine agencies.

Kamran Mughal who was most vociferous at raising slogans in favour of Jammu & Kashmir's independence on the Pakistani prime minister's visit is reported missing:

It should also be noted that Kamran's brother and brother in law were also picked up by the AJK police under instructions from Pakistan's agencies yesterday morning. They were detained all day and reportedly tortured so that they may disclose the whereabouts of Kamran. In the evening they were released after civil society intervened.


Meanwhile, 21 year old Khwaja Mujtaba Bandey remains in custody while the 7 other detainees have been released. He and I spent a week together in Sharda this summer, even scaling the heights of Narda Lake at 15,000 feet. He is into his 3rd night of incarceration today:




The Pakistani State must be held accountable for creating friction between the AJK police and the public. For showing a 'strong hand' in Muzaffarabad where reports of torture under the instruction and supervision of Pakistan's roving agencies have emerged. Equipment of the earlier detained and released has been allegedly confiscated by them too.


As usual, the police and administration in AJK regret their helplessness in having to obey 'orders from above', from shadows that have no legal writ in this territory.

Meanwhile, this afternoon a meeting took place in Rawalakot between civil society and the Poonch administration in reference to the 37 activists. detained since the 7th of September. 

Here's a translation of the Urdu report on the discussion, written by Haaris Qadeer:

- The Gvernment has announced that it will withdraw all cases
- It has decided to unconditionally release the 'Freedom March' prisoners

Rawalakot - Mujaadala News 

The government has announced that it has withdrawn all cases against the participants of the Freedom March (and subsequent sit-in protest at Tithrinote on the 7th of September) and decided to unconditionally release all those detained. These decisions were made by a co-ordination committee headed by the minister of information (in the AJK Assembly) Mushtaq Minhas. 

This emerged after a 2 and a half hour discussion between representatives of the AJK government and a civil society delegation led by Chairman Liberation Front (JKLF) Sardar Muhammad Sagheer Khan Advocate. Amongst the government's representatives were Information Minster Mushtaq Minhas, local MLA Sagheer Chugtai, former minister Sardar Tahir Anwar, representative of JKPP (Jammu Kashmir People's Party) Asad Ibrahim and DG Political Affairs to prime minister Malik Zulfiqar. Others were present too whereas accompanying Chairman Liberation Front Sardar Muhammad Sagheer Khan Advocate were former presidents of NSF (National Students Front) Basharat Ali Khan, Tauseef Khaliq and journalist Haaris Qadeer. 

Prime minister Raja Farooq Haider also talked via telephone with Sardar Muhammad Sagheer Khan Advocate during the discussion. On the directions of the prime minister the government announced that it was withdrawing all cases and hence decided to release all prisoners unconditionally. 

SSP Poonch was reprimanded for his professional misconduct and it was decided that the government would form a departmental inquiry to investigate this matter. In consequence, Chairman Liberation Front (Sagheer Khan) decided to call off protests in other districts and announced that the ensuing protest in Rawalakot would convert itself into a welcoming rally (for the  Freedom March prisoners). 

Commissioner Poonch Choudhary Muhammad Raqeeb and Deputy Commissioner (DC) were also present on this ocassion, who upon the AJK prime minister's orders assured that they would immediately implement the instructions given.

This meeting ended at 1700hrs (5pm). However, by midnight the 37 prisoners had yet to be released.

Daily Diary (DD) - Day 207 of 2019

0000hrs:

I've just missed out on posting on Day 206 by a few seconds!

We returned to Sharda (6,200 feet) from Narda (Lake at 15,000 feet) this afternoon after 72 hours of the most gruelling physical journey I've ever undertaken in 47 years.

The elation felt at achieving this feat was worth every exhausted bone in my body.

Youth of Khwaja Seri conferring outside PS Sharda

Coming back to Sharda, this morning the youth of Khwaja Seri urged me to accompany them to Sharda Police Station to pursue the progress of investigation into the alleged rape by Abid Shah of Kharigam (near Sharda) a few days ago:



A brief profile of his alleged victim:

- 17 yrs old
- FSC 2nd Yr Student
- D/O Khwaja Waheed - of Khwaja Seri

A strong discussion ensues at the police station where we learn that the concerned investigating officer and Station House Officer (SHO) have taken Abid Shah to the district capital of Athmaqam for interrogation by SP Neelam. Meanwhile, staff present try to defend their investigation which the youth are not convinced of:

It is apparent that:

- The police have used weak charges, namely 10 ZA (HA) and 14 ZA which are easily bailable.
- The alleged perpetrator has committed this sort of crime multiple times before. It is further alleged that gang rape has been the modus operandi.
- There are 2 other people in custody who remain at Sharda police station, allegedly connected to this crime. Upon request, I was not allowed to meet them. It is claimed that there were at least 5 co-conspirators.   
- It is alleged that Abid Shah's co-conspirators were hotel staff at Benazir Palace. There is also speculation that these staff double as government employees at Bagh University.
- It is not even clear if a forensic investigation has been pursued by the police. In any case, the only forensic lab available is in Lahore. There is no such facility in AJK and thus costs money, involves considerable delay in clarifying investigations here. It appears that the police are usually discouraged from taking such steps. 
- It is also claimed that various powerful people are behind the silencing of such crimes, which interconnect various other vices in society.

I explained to the police that I have worked on many cases before and a lot of effort is taken to obtain even a semblance of justice, never 100%. This case needs to be different.

Some of the youth are keen on blocking roads throughout the district of Neelam and to extend agitation throughout AJK. I explain to them that they should verify and ensure that the alleged victim's statement is wholly true. That they should then pursue 5 levels of the local police structure consistently and meaningfully:

Namely, 

1) Investigating officer
2) SHO (Station House Officer)
3) DSP (Deputy Superintendent)
4) PDSP (Prosecuting Deputy Superintendent)
5) SP (Superintendent)


Having gone through the above process, they should then pursue other avenues of peaceful protest.


Meanwhile, discussing this matter with the residents of Sharda confirms many of the allegations cited above. It is also clear that the local people want justice to be done, in a manner which creates a deterrent for such practices in future. They realise that the image, dignity and honour of Neelam is at stake. 

I would add that governance cannot operate without an efficient administration and judiciary. Our society has lagged way behind in all fields thus far since 1947. Our government as well as our people need to sharpen up quickly. Otherwise.....
