After releasing our first draft of the Citizen's Charter JKA on the 10th of October 2022 (last month) and then subsequently receiving valuable feedback from a variety of our co-citizens - at home and abroad - we have now released a snapshot version of the Charter today. Here it is:

Citizen's Charter JKA (Snapshot version) 22/11/2022 
(Amended 25/11/2022)

1) Security
Ending all proxy wars and attrition while maintaining geopolitical neutrality

The territory of Jammu Kashmir & Allied areas ((JKA) must not be used to conspire to commit violence - or harm - on behalf of any country, at the expense of any other, for any reason.

2) Governance
Protecting the original demography of JKA and its natural resources

Both India and Pakistan should immediately take appropriate measures to rollback all demographic changes conducted here post 15 August 1947 and honour the State Subject Rules of 1927.

3) Economy
Restoring all universally recognised freedoms

Essentially, this is a subject of governance but our economy cannot function without the restoration of these rights including the freedom of expression, assembly, association, movement and recourse to law; including international law where appropriate.

4) Culture
Reviving diversity and introducing inclusivity

All mandirs, masaajid, gurdwaras & other places of reverence must be revived & accessible to all; in particular those places of worship that have been abandoned since 1947.

Notes of clarification:

Despite being primary victims, we bear no ill will towards India, Pakistan or any other country. Rather, we are most incentivised to transform this territory from an economy of conflict to an economy of peace.

Our water and geography can be a boon instead of a curse for our neighbourhood and help revive the 20% plus share of world GDP here pre European colonialism. No human dilemma is intractable if comprehensively thought through, by giving precedence to the enhancement of human capital throughout the region.

(Update at 1705hrs on 25/11/2022 - As can be noted from the title we have amended the snapshot version of the Citizen's Charter after feedback from our co-citizens. We will make further amendments in due course as and when feedback is received. Note that we will try and keep it concise, targeting a maximum of 250 words. The first version was 217 words and this version is now 261 words.)   

Further to our notes released on Day 322 of 2022 we have shifted our list of all notable political, social and scholarly personalities throughout the State and will invite them one by one to participate in our Space - without exception - to conform to the ideals of 'inclusive politics'. This will remain our new subject title for the foreseeable future, until we have compiled a full list of political parties, social groups, professional associations and State institutions (where relevant).

Here's the list of public bodies (rather their official responses): 

They will be updated as and when we are successful in inviting them. It will attempt to include all the following features: 

A) Name/photo/region/area

B) Organisation/rank/capacity/website reference 

C) Social/political theme (that they espouse) and their written response which should be no longer than the snapshot charter itself (recommended response is 100 to 250 words).

D) Date response received and status of invitations where possible.

n.b. We will try and invite the senior most member of the party or organisation/institution concerned and failing that will seek out the second in command and so on etc. The list will be in the order of the responses received. As intimated earlier, it will try and include every significant public personality throughout the divided territory.

1) Choudhary Zahoor Kashmiri of Raj Mahal Kotli AJK

He describes himself as a simple worker of the JKLF (Jammu Kashmir Liberation Front) and is not a part of any faction. He has been included on merit because he has and is working hard to bring unity amongst all freedom-loving parties in the territory.

- A total withdrawal of foreign occupying forces.  

- Our resources should be in our control.

- Our country must be ruled by our own people.

- The freedom movement should be galvanised and organised down to the level of wards (urban areas) and union councils (rural areas). 

- The freedom revolution can only be realised by increasing public consciousness at a collective level.

- This will usher in an era of freedom and prosperity.

- These are the few words that I can offer (in response to the Citizen's Charter).

2) Kranti Bhushan of Jammu whose parents had to forcibly migrate from their original home in Muzaffarabad in 1947. 


His designation is as Principal Consultant, HKD Consulting Engineers & Founder/General Secretary of SEARCH (Saving Environment and Activism for Restoration of Culture and Heritage).

We as citizens of India consider Jammu & Kashmir an integral part, based on historical and constitutional facts. Since Vedic times (scriptures date back over 5,000 years) Kashmir has been a centre of spiritual learning. Kalhan’s 12th century ‘Rajatarangani’ (translated from Sharda script to English by Hungarian-British linguist Aurel Stein in 1900) confirmed these Vedic roots and their association with the rest of the country. 

Geographically, it is true that Kashmir was not initially connected to modern day India, which appeared better accessible through Muzaffarabad, from where the river Jhelum flows south but India - or Bharat - before 1947 included all these areas, including Peshawar.

At partition, the Kashmir kingdom had a choice to accede with either India or Pakistan and the ‘Instrument of Accession’ was signed by Maharaja Hari Singh in favour of India, hence J & K constitutionally became an integral part of India, including those areas under Pakistan’s occupation. India’s parliament passed a resolution in 1994, confirming POJK an integral part, pending annexation. 

Even in the recent delimitation exercise for J & K by the central government, they have retained reserved Assembly (and Council) seats for POJK, on which elections will now be contested.

UT status is a temporary measure. J & K will revert to a State. We are clear on that. We eagerly look forward to POJK formally merging with the State of J & K.

3) Shiban Koul aka Santosh Kashmiri was born and brought up in village Seer Hamdan, district Anantnag (Valley of Kashmir)


He has worked with trade unions as general secretary of the Confederation of Central Government Employees Jammu & Kashmir. Currently he is associated with a civil society initiative namely Lok Manch (a Jammu based people's initiative which works for Indo- Pak Peace and peaceful resolution of all mutual conflicts). Peaceful co-existence, global warming and climate change are at the centre of all initiatives of the organisation.

Written response:

I agree with all the points. Very beautifully drafted. Though proxy war has been waged by Pakistan not India in 1989, I still agree with the wordings used in the sentence to enable people across the divide to rally on this demand to ensure that this proxy war is stopped without any further delay. As regards demographic changes, no such changes have occurred even after abrogation of 35A of the Indian Constitution and after making Article 370 in-operational. However, in Gilgit Baltistan State Subject Rules were abrogated in 1974 and there has been a huge demographic change. 

We must demand restoration of State Subject Law in both the areas. I am of the opinion that we should encourage a multi-layered dialogue among the people of JK and at the same time encourage both Pakistan and India to enter in to dialogue at bilateral level, which can be concluded in a trilateral framework after a consensus is evolved among the stake holders within the JK State.

Jammu Kashmir is a trilateral dispute and a source of utmost enmity between India, Pakistan and Jammu Kashmir. The latter’s division has become the fundamental reason for the violent clash between pro and anti militancy forces. 

Nature Mankind Friendly Global Party (NMFGP) suggests a superb solution for this. (Namely) to reunite the State of Jammu Kashmir in its (original) shape as in 1947 and grant it autonomy in a federal structure. Which under the joint administration of India and Pakistan would surface as a 'Nature Mankind Friendly' condominium. This solution would bind the genuine interests and aspirations of all 3 parties into a treaty that could be acceptable to all.

This ‘Joint Condominium’ would achieve parity between all 3 parties whereby the territory of the State of Jammu Kashmir would no longer be used against any other country. Thus, helping us emerge out of this dark and dangerous pit in which we have been stuck in since 1947. Sectarianism promoted during the British colonial era paved the path for Jammu Kashmir's inhumane division, as per the British agenda.

NMFGP proposes strict adherence to the State Subject Rules of 1927 and 1932 which would be pragmatic, as correcting mistakes and destruction of the past would provide a historic milestone.

Economy....NMFGP proposes that this territory be developed as a global hub for tourism, horticulture and clean energy production.

NMFGP will sincerely pay particular attention to unemployment, poverty, social security for the elderly, the rights of labourers & farmers and gender equality.     

Respecting all religions and ensuring the protection of all their places of worship. Global Party's road map is to galvanise the State of Jammu Kashmir's development as a strong bridge of peace, friendship, co-operation and joint prosperity. This inspirational trilateral model would mitigate (the effects) of the bloody division in 1947.

You are accumulating a pertinent data on a lasting and internal or home solution to the home problem. A sensible and self-conscious people always have their own agenda and formulas. 

It is unfortunate that some of the subservient or imposed leaders of our divided state of JK beg their masters and occupiers for a solution to JK issue. 

Yes,  "Economic Peace" requires social, cultural and religious tolerance. India and Pakistan only teaches people what divides them, not what unites them. Economic necessities have forced the people of this region to migrate to completely alien cultures, where they haven't only readjusted but joined the ruling classes. The British PM and Ministers in the UK are a prime example. Yet, many people argue they can't live together at home due to religious and cultural differences. We must shun such ideas and revisit our past where our ancestors happily lived together.

....Re-establish de jure status and de facto status 

Otherwise, organisations working as marginalised entities, factions, loose alliances and political parties operating under unnecessary and illegal restrictions for 75 years.

This is a hard - circular - route and fraught with unnecessary complications.

Organisations that want to address foreign presence in JKA using democratic, ethical, legal and peaceful means are crowded out from doing so and the people do not enjoy any civil protections in this regard.

Those civil protections need a codified (citizen's) charter inclusive of all and agree-able by the majority. That is only possible on the ground in AJK.

So, how do I engage with the public?

What are the terms of reference between the public and me?

On a specific political party platform that is not representative of the population and will not gain the required attention of the 'international community'?

Or do I engage the public as a whole and pursue a Public Assembly session (to prove representative political consensus) that will succeed in engaging the 'international community'?

It’s meaty that’s for sure. I could probably go paragraph by paragraph and dissect it all but I need a solid few hours (for that). 

I appreciate it’s the very first draft and there will be many edits before it’s finalised.

The first thing I would like to add to keep things moving at a steady pace is that we need to remove all the whys and fill them with answers.

It’s a charter so needs to be solid and explicitly express it’s purpose and points.

It needs to remain to the point and crystal clear in every respect. Once it’s finalised it needs to (be) translated into Urdu, turn it into a video with audio and subtitles of the script.

Once all how’s, why’s are replaced with clear concise answers and solutions then it’s going to be binding.

MR:

Thanks for all that. The questions are to provoke thinking, in order to understand. They can be transformed into answers no doubt. I have sent it to some legal experts too as well as political activists, academics and journalists...So, let's see how they respond.... 

Admittedly it is meaty, in an effort to compress many layers of complexity. Please feel free to comment and dissect further.

RS:

This stuff is way too advanced for majority of our people. The awareness campaign will have to summarise this and break it down in bits so people can understand. You can have a whole university course on this topic to be honest. Maybe that’s another option to explore. Provide funding for a course and then get maximum students on it.

At least people graduating from the course can then even join in a civil services capacity, they will also be more professional and polished off. These people would eventually take up senior positions after starting from the bottom. This will ensure our top tier understands the fundamentals and is unshakeable. During the degree/course we can emphasis and have a model which highlights the issues related with corruption and the downfall it causes. Principles and morals need to be built into people and then brought into governance and then the wider public can be trained/maintained. Without routing out corruption/falsehood and lies - especially in an administration position - will just bring the same results as it does in Pakistan and Kashmir for over 75 years.

Yes, I am in discussions with some experts to design a public policy course in the near future. Hopefully, soon after I finish my course.

There must be a form of attraction and incentives to motivate people in the present to build a path for the future. Many generations here have been tricked into planning for the future while not dealing with the present. It hasn't worked.

This document of yours is the result of  a well-committed extensive research. You have accurately stated that all the parties related to the Jammu Kashmir issue i.e. the occupiers, UN, USA and UK have failed to resolve this issue, simply because they have neglected the representation of the primary party such as the people of Jammu Kashmir. The leadership of Jammu Kashmir is mainly responsible itself for its own  lack of representation. The well thought over idea of Public Agency should be embraced and promoted by the citizens of JKA with all their resources to  promote their own narrative. No other narrative is going to resolve JKA issue but that of its own.

4) A government servant (They have to remain anonymous while in service for obvious reasons, not least for being illegally bound in a mono narrative)

Refreshing approach indeed. A people centric coalition amongst ethnic and religious groups of erstwhile state of J&K will be haunted by skeletons in our cupboard. For example, Jammu massacre, Pandit exodus, tribal invasion etc.

There is an increasing amount of evidence suggesting Muslim majorities have failed to protect rights of non Muslim minorities around the globe which will hamper any consensus development.

MR:

We can change that record for the better here and create a working example. These sensitive issues cannot be avoided, they have to be confronted in the most humane way possible.

Many thanks. Even discussing these matters and logging people's thoughts in writing will create a positive vibe. I have learned this from activism on the ground to revive Mandirs and Gurdwaras here ref. Sharda & Alibeg in particular.

To be brutally honest, it is not inviting to read at first glance, unnecessarily loaded with references to many conflicting  political and ideological positions and one would struggle to find the "charter".

It is a first draft and has been sent to a number of people for a brutally honest review. I will not defend or qualify it at this stage but I would appreciate it if you can elaborate with an example - if possible - on what you consider to be 'conflicting political & ideological positions'?

It is a great effort with noble objectives but i think needs clarity as to 'whom it may concern' . I mean exactly who is this for and how it is aimed to be achieved? Individually or through some organisation? costings?

Great! Many thanks. I will have a look. It is a first draft of course and I hope to incorporate all reviews received before I publish second draft.

It has 2 dimensions. 1 for the world and the other for the people viz. co-citizens. It can be considered to be a formal contract. Subject to amendments in the future and hopefully the basis for a genuine people's referenced constitution.

Aims to be achieved through OBMs (Ownership Building Measures) carried out by AJK Public Agency and financed by the public as a whole. The first target is 100,000 citizens.

This research article is very comprehensive & clearly stand that State of Jammu Kashmir is, was an independent (country) & should be. 
UNO (United Nations Organisation) have given us birth right of independence but regional countries are not willing for it.

10) Mohsin Mumtaz:

The division of Jammu Kashmir state not only have resulted in killings of citizens of JK but this unjust division responsible for exploitation of resources of our state, poverty, starvation, lack of basic health and educational facilities too. United Nations and it's member states especially P5 pledged us that they will endeavour to hold free and fair plebiscite to gauge the opinion of people of JK state but failed so far.
 
Currently both India and Pakistan endeavouring to permanently divide our state by scraping State Subject Rule (Pakistan bifurcated it's controller parts of JK state into AJK and GB and abandoned state subject Rule in 1970s) whereas Modi lead fascist state of India Bifurcated Indian held JK into two union territories Ladakh and Jammu Kashmir and downgraded statehood of Indian held JK by amending article 370 and scraping 35A of Indian Constitution. 35A Guarantees the state subject Rule shall be upheld whereas 370 guarantees statehood of Indian held JK till the final solution of Jammu Kashmir state. Steps taken by both India and Pakistan are against their commitments made before UN and ultimately with aspirations of public of Jammu Kashmir.

Jammu Kashmir state existed as a secular state prior to 1947 and there none of any colonial riot erupted in the name of religion between the majority and minority communities of state. So claims of both occupiers are baseless that religion and we the citizens of the state want to leave together with peace as we lived before 1947 and want to upheld our peculiar identity in future too rather dumping resources rich state of twenty million into a sea of aggressive states of India and Pakistan where there is no rights of minorities and their masses still lack fundamental rights and basic facilities.

I totally endorse this citizen's charter of JKA without any prerequisite. Our public throughout the state wanted their own country where there will be no explanation, where fundamental rights of every state subject shall be honoured.

11) Professor M Sajid Yusuf:

‘Citizens Charter Jammu Kashmir & Allied (areas) JKA’ appears to be a promising documented milestone for the preservation of identity with respect to culture, geography, politics, economy, natural resources of all the inhabitants irrespective of creed, caste, belief or association. The Charter unearths comprehensive details relating to genuine and factual problems confronted by the inhabitants of the Princely state of JK entailing internal and external factors influencing and affecting its demography.  

According to Allama Iqbal, (Narghas apni baynoori pe roti hai hazaron saal; barhi mushkil say hota hai chaman mein deedawar peda). Mr. Tanveer Ahmed is not only a born scholarly man whose selfless efforts are directed towards providing a roadmap for restructuring and rebuilding a system; sovereign, and democratic with a documented economic vision for the future but also outspoken and vocal brazenly bold and brave in his words and actions. At a loss for words!

Para 1) rightly highlights the issues inherited due to various themes leading to utter failures in addressing people’s grievances despite imposing their self-styled decisions other than what was stipulated in UNO.   

Para 2) affirms that the division of the territory is repugnant to the UN resolution framework. From the historical perspective, sovereignty in the rule has always been influenced by an external change in governments resulting in neither democratic nor autocratic in its form. 

I wish I could contribute more in writing but time constraint. By God willing, soon some suggestions in the review will be submitted. Thanks wishing you many triumphs.
